Публічне адміністрування землеустрою в Україні: проблеми та шляхи їх вирішення

Abstract

Досліджуються проблеми публічного адміністрування землеустрою в Україні та надаються шляхи їх вирішення. Зроблено порівняльно-правовий аналіз землеустрою з використанням міжнародного досвіду. Запропоновано нову інноваційну модель механізму публічного адміністрування землеустрою та програму розвитку й використання, охорони земельних ресурсів. Організаційно-правовий механізм публічного управління в сфері землеустрою в Україні не є ефективним повною мірою, недостатньо вивченим та потребує удосконалення. Запропоновано удосконалення зазначеного механізму. We investigate the problems of public administration of Land management in Ukraine and solutions are provided. Made comparative-legal analysis of land management with using international experience. A new innovative model of mechanism of Land management and development and use program of land conservation. Organizational-legal mechanism of public management in the field of land management in Ukraine has not been effective in full, inadequately studied, it is the one that needs to be improved. In this article, an improvement of the mechanism proposed. The main task – development of new directions and land management strategies for further effective management in the field of protection and land use. In view of foreign experience, in Ukraine it is necessary to differentiate the competence of public authorities and their powers in the field of land management and introduce comprehensive programs that will help ensure effective public administration in this area. We also believe that in order to ensure decentralization of land management powers under the current conditions of the European integration process, an improved mechanism for the provision of administrative services should be introduced with regard to the registration of the application for state registration of the land plot by certified engineers of land managers in electronic form using web technologies, using a personal electronic digital signature, shortening the term of state registration of land Therefore, there is also a need to amend the Law of Ukraine “On the State Land Cadastre” (to expand the list of persons who make information in the State Land Cadastre and provide relevant information from it). Also, in view of foreign experience, in Ukraine it is necessary to differentiate between the competence of public authorities and their powers in the field of land management and to introduce complex programs through which effective public administration in this field will be implemented. Analyzing the state of development of processes of land management and transformation of land legal relations in the conditions of Eurointegration process, we propose to adopt the Program of development and use, protection of land resources, which would determine the basic principles of functioning and improvement of public administration of land management in modern conditions. Исследуются проблемы публичного администрирования землеустройства в Украине и предоставляются пути их решения. Сделан сравнительно-правовой анализ землеустройства с использованием международного опыта. Предложена новая инновационная модель механизма публичного администрирования землеустройства и программа развития и использования, охраны земельных ресурсов. Организационно-правовой механизм публичного управления в сфере землеустройства в Украине не эффективен в полном объеме, недостаточно изучен и нуждается в усовершенствовании. Предложено усовершенствование этого механизма.
