The article argues for the need to develop the internal potential of Asian companies against the background of strengthening international economic ties and improving the investment climate of countries participating in investment processes. The example of China's investment activity in Asian countries shows that, despite global crisis phenomena and upheavals, a grandiose potential has been formed for the implementation of important global initiatives, the most powerful of which scientists, practitioners and even politicians rightly consider the "One Belt One Road" project. Large-scale foreign investments and the choice of appropriate methods of cross-border entry into markets of potential investment interest have a decisive influence on the success of large Chinese enterprises in the context of the development and implementation of this project. At the same time, the authors emphasize the choice of such methods of investment interaction as mergers and acquisitions (M&A) or greenfield investments. Based on the use of economic and mathematical modelling, the authors demonstrated the influence of internal and external factors on the choice of investment method by large Chinese companies in countries that are promising partners in the implementation of China's global initiative "One Belt One Road". The analysis of the potential for investment begins with the division of factors into two conditional groups, on the one hand, it is about the intra-corporate potential in the composition of the factors of strategic assets, technical capabilities, international experience, capabilities of enterprise management and the scale of the enterprise. On the other hand, the external environment is taken into account, the analytical assessment of which is based on the index of infrastructure development of the host country, control over capital and the value of cultural distance. Considering the research interest, as part of the analysis of the investment potential for cross-border interaction, such countries as India, Indonesia, Pakistan, Kazakhstan and Vietnam along the route were selected. Through the quantitative analysis of 108 investment projects in 6 countries, a benchmark for the entry of foreign investment by Chinese large enterprises through mergers and acquisitions (M&A) or greenfield investment has been obtained. Розбудова спільноти єдиної долі людства має великий інвестиційний потенціал, повноцінне розкриття якого залежить від ефективної співпраці не лише держав, а й корпоративного сектора, особливо в транскордонному форматі. У статті аргументовано необхідність розвитку внутрішнього потенціалу азійських компаній на тлі зміцнення міжнародних економічних зв’язків та покращення інвестиційного клімату країн-учасниць інвестиційних процесів. На прикладі інвестиційної активності Китаю в країнах Азії показано, що, попри глобальні кризові явища та потрясіння, сформовано грандіозний потенціал для реалізації важливих глобальних ініціатив, найпотужнішою з яких науковці, практики й навіть політики справедливо вважають проєкт «Один пояс – один шлях». Масштабні іноземні інвестиції та вибір відповідних методів транскордонного входу на ринки потенційного інвестиційного інтересу мають вирішальний вплив на успіх великих китайських підприємств у контексті розвитку й реалізації цього проекту. При цьому автори акцентують увагу на виборі таких способів інвестиційної взаємодії як злиття та поглинання (M&A) або інвестиції типу гринфілд. На основі використання економіко-математичного моделювання авторами продемонстровано вплив інтернальних та екстернальних чинників на вибір способу інвестування великими китайськими компаніями в країни, що є перспективними партнерами в реалізації глобальної ініціативи Китаю «Один пояс – один шлях». Аналіз потенціалу для інвестування починається з розподілу факторів на дві умовні групи. З одного боку, ідеться про внутрішньо корпоративний потенціал у складі факторів стратегічних активів, технічних можливостей, міжнародного досвіду, можливостей управління підприємством та масштабу підприємства. З другого боку, до уваги взято зовнішнє середовище, аналітична оцінка якого базується на індексі розвитку інфраструктури країни-реципієнта, контролі над капіталом та величиною культурної дистанції. З огляду на дослідницький інтерес, у рамках аналізу інвестиційного потенціалу для транскордонної взаємодії обрано такі країни як Індія, Індонезія, Пакистан, Казахстан і В’єтнам уздовж маршруту. The first has been to broaden the collateral based approach by encouraging bank lenders to finance SMEs with insufficient collateral. This might be done through an external party providing the collateral or guarantees required. The second approach has been to broaden the viability based approach. Since the viability based approach is concerned with the business itself, the aim has been to provide better general business development assistance to reduce risk and increase returns. These two approaches in overcoming the SME finance gap are implemented and consistent with Profit and Loss Sharing Model, also called PLS or “participatory” banking. Profit and Loss Sharing is a method of finance used by Islamic financial or Shariah-complaint institutions to comply with the religious prohibition on interest on loans that many Muslims subscribe to.Item Аналіз моделей заснованих на оренді в рамках ісламської економічної доктрини(ТОВ «Редакція журналу Економіка та держава», 2022) Юркевич, Оксана Миколаївна; Yurkevych, Oksana; Юркевич, Оксана Николаевна; Мозговий, Олег Миколайович; Mozghovyi, Oleh; Мозговой, Олег НиколаевичІснування в ісламській економічній доктрині певних заборон, продиктованих положеннями ісламського права, визначає специфічні організаційно-правові форми фінансових відносин та інструменти здійснення / фінансування економічної діяльності. Головною з таких заборон є — ріба (позичковий процент), яка унеможливлює існування класичного кредиту в рамках концепції ісламських фінансів. Ісламські фінанси мають контрактну форму і можуть функціонувати в межах трьох моделей, заснованих на: 1) торгівлі, 2) оренді або 3) партнерстві. Найбільш гнучкою і модальною формою є оренда (іджара), за допомогою якої відбувається не тільки структурування кредитної угоди, але також і класична сек'юритизації певного товарного активу, що своєю чергою, дозволяє змоделювати відносини "кредитор-позичальник" в рамках емісії такого фінансового інструменту як сукук — аналога класичної облігації. The existence of certain prohibitions in Islamic economic doctrine, dictated by provisions of Islamic law, determines the specific organizational and legal forms of financial relations and tools for implementing / financing commercial activities. The most important of these prohibitions is riba (loan interest), which makes it impossible for classical credit to exist under the concept of Islamic finance. Islamic finance has a contractual form and can operate within three models based on: 1) trade, 2) leasing or 3) partnership. The most flexible and modal form is the lease (Ijarah), which is not only the structuring of a loan agreement, but also the classic securitization of a particular commodity asset, which in turn allows an agent to model the relationship "lender-borrower" within such financial instrument as a sukuk — an analogue of the classic bond. However, we believe that the lease-based models discussed in the article have a significant disadvantage for their usage in Islamic banking. Firstly, the "commodity" nature of financial transactions adds to sovereign risk of the "borrower" (the ability and willingness of the lessee to pay rent), as well as the risk of price fluctuations in commodity markets that occur from potential changes in asset prices. Secondly, some additional costs for maintenance and insurance of a commodity asset / property may not be calculated in advance. Which makes it impossible to determine the fixed expected net return on some forms of lease securitization (Sukuk al-Ijarah) before the issue is initiated. In addition, finally, thirdly, the weak point in the models based on securitization of lease is the lack of principle of unconditional payment by the Obligator for its obligations. Since this form of contract is not a bond (in its classical sense), under which in case of default the issuer is liable to the holder with all its assets. Фінансування комерційної діяльності шляхом створення партнерських організаційно-правових форм в рамках Моделі спільної участі у прибутку та збитку (англ. Profit-and-loss-sharing model (PLS model)), вважається ключовим елементом всієї ісламської економічної доктрини. До таких моделей можна віднести: мудараба та мушарака. Можна констатувати, що контрактні форми, реалізовані в моделях функціонування ісламських фінансів є доволі модальними інструментами, які з одного боку дозволяють «замаскувати кредитну операцію» через купівлю/продаж реального активу з іншого, розширюють сферу застосування партнерських (дольових) відносин. Певним аналогом мудараба у традиційних фінансах є закритий інвестиційний фонд, деякі типи Інститутів спільного інвестування (ІСІ), венчурний фонд, траст, строковий депозит. Аналогом мушарака у традиційних фінансах є: командитне товариство, партнерство з необмеженою/обмеженою відповідальністю, угода про розподіл прибутку, банківський овердрафт. Islamic finance has a contractual form and can operate within three models based on: 1) trade, 2) leasing or 3) partnership. Financing commercial activities through the partnership within the Profit-and-Loss-Sharing Model (PLS model) is considered as the key element of all Islamic economic doctrine. Such models include mudarabah and musharakah. It can be stated that contractual forms implemented in the models of Islamic finance are quite modal tools, which on the one hand allow to “hide credit transaction” (through buying / selling a real asset), on the other hand, expand the usage of partnership (equity) relations. A certain analogue for mudarabah in conventional finance is a closed investment fund, some types of mutual funds, a venture fund, a trust, and a term deposit. Analogues of musharakah are limited partnership, partnership with unlimited / limited liability, profit sharing agreement, bank overdraft. The following reasons can be identified that prevent the effective application of partnership-based models in business, which in turn, as mentioned earlier, are the key element of Islamic finance. First, “to develop a partnership” is not the ultimate goal of the bank, so it should be temporary, as the bank does not have the intention to own the company’s assets or participate in the management and strategic development of the business. Due to this, it is very difficult to reconcile the division for spheres of management and control in corporate governance of the business. Second, numerous opportunities for “opportunistic (irresponsible) behavior” of the Islamic Bank’s partner require supervision that is more complex, which in turn increases the transactional costs of the whole business. At the same time, existing limitations for hedging do not reduce aggregate risk. Third, the concept of “partnership” is usually a pooling of capital, which requires a careful assessment of the value of the other party’s share, because the profits of an Islamic bank are the difference between the original cost of capital and its value by performance. Obviously, doing this in the format of a “flow” of various “projects” is very difficult, and effectively manage the loan portfolio through the borrower’s credit rating (conventional bank) easier than the portfolio of projects by estimating the future value of their cash flows (Islamic Bank).Item Модель здійснення банківської діяльності в доктрині ісламських фінансів(Київський національний економічний університет імені Вадима Гетьмана, 2022) Юркевич, Оксана Миколаївна; Yurkevych, Oksana; Юркевич, Оксана Николаевна; Субочев, Олексій Валерійович; Subochev, Oleksii; Субочев, Алексей Валерьевич; Мозговий, Олег Миколайович; Mozghovyi, Oleh; Мозговой, Олег НиколаевичСтаття зосереджує увагу на існуючих контрактних формах залучення капіталу ісламським банком, тобто на процесі здійснення банківської діяльності в доктрині ісламських фінансів. Досліджено модель провадження банківської діяльності в ісламській економічні доктрині і визначено інструменти її реалізації. Ісламський банк (так само, як і конвенціональний) пропонує клієнтам подібні види банківських послуг, які можна об’єднати у три типи депозитних рахунків: а) поточні; б) ощадні; в) інвестиційні. На сьогодні для залучення коштів в ісламському банкінгу застосовуються (крім контракту мудараба – Модель спільної участі у прибутку та збитку) такі форми, як: вадіа (безвідсотковий депозит); вакала (депозит); кард аль хасан (безвідсоткова, або благодійна, позика), що функціонують на основі агентських відносин між ісламським банком та його клієнтом. Окремим способом фінансування малого та середнього бізнесу (МСБ) в концепції ісламського банкінгу є хавала – функціонує як неформальна фінансово-розрахункова система на основі взаємозаліку вимог та зобов’язань між учасниками, та кафала – фінансовий контракт, який передбачає передачу ризику і відповідальності. Дослідження сервісних контрактів, вакала, хавала та кафала, дозволило порівняти їх з аналогами у конвенціональних фінансових відносинах та дійти висновку, що ісламський банк є звичайним фінансовим посередником, який виконує подібні конвенціональному банку функції на фінансовому ринку, проте за допомогою специфічних контрактних форм, що узгоджуються з ісламським правом. Здійснено критичний аналіз поняття «поточна надбавка» (маржа) фінансової установи в концепції безвідсоткового банкінгу, яка у підсумку формує її прибуток. Критично досліджено концепцію створення ісламського міжбанківського ринку на основі «ісламських принципів», тобто з закріпленням домінуючої ролі Моделі спільної участі у прибутку та збитку, яка є ключовим елементом ісламської економічної доктрини. Виокремлено деякі суттєві обмеження щодо можливості ефективного функціонування даної концепції на практиці – в умовах конкурентного фінансового ринку відкритої ринкової економіки. Загальним висновком дослідження є те, що, незважаючи на значну кількість розроблених та стандартизованих організаційно правових форм та моделей здійснення банківської діяльності в доктрині ісламських фінансів, все ж таки лишаються суттєві суперечності та невирішені проблеми стосовно ключових економічних категорій, таких як, наприклад, визначення надбавки (маржі), використання інструментів міжбанківського фінансування, ефективне управління банківською ліквідністю. Причому, на нашу думку, розв’язання деяких суперечностей у рамках парадигми безвідсоткового банкінгу є складним завданням для ісламських юристів, економістів, фінансистів. The article focuses on the existing contractual forms of raising capital by an Islamic bank, i.e. on the process of banking in the doctrine of Islamic finance. The author studies the model of banking activity in the Islamic economic doctrine and identifies the instruments for its implementation. An Islamic bank (as well as a conventional bank) offers its customers similar types of banking services which can be grouped into three types of "deposit" accounts: a) current; b) savings; c) investment. Today, Islamic banking uses the following forms of fundraising (in addition to the mudarabah contract – the profit and loss sharing model): wadiah (interest-free deposit); wakala (deposit); qard al-hasan (interest-free or charitable loan), which operate on the basis of an agency relationship between the Islamic bank and its client. A separate method of financing small and medium-sized businesses (SMEs) in the concept of Islamic banking is hawala, which functions as an informal financial and settlement system based on the offset of claims and obligations between participants, and kafala, a financial contract that involves the transfer of risk and responsibility. The study of service contracts, wakalah, hawala and kafalah allowed comparing them with their analogues in conventional financial relations and concluding that an Islamic bank is an ordinary financial intermediary performing functions similar to those of a conventional bank in the financial market, but with the use of specific contractual forms consistent with Islamic law. A critical analysis of the concept of "current premium" (margin) of a financial institution in the concept of interest-free banking, which ultimately forms its profit, is carried out. The concept of creating an Islamic interbank market on the basis of "Islamic principles", i.e., with the dominant role of the profit and loss sharing model, which is a key element of Islamic economic doctrine, is critically examined. The author identifies some significant limitations to the possibility of effective functioning of this concept in practice – in a competitive financial market of an open market economy. The general conclusion of the study is that despite a significant number of developed and standardised organisational and legal forms and models of banking activities in the Islamic finance doctrine, there are still significant contradictions and unresolved problems with regard to key economic categories, such as, for example, the definition of "margin", the use of interbank financing instruments, and effective management of bank liquidity.
