Abstract
In this scientific paper using modern methods of scientific understanding of social
phenomena, the authors have carried out the historical and legal introspection of the
connections and interferences in the political process, legal ideology, and creation of
regulatory acts of English society of the seventeenth century. The authors have established
the characteristics of the development of state and legal views of the Protestants and in
particular Independents and Levellers as well as the conceptual formation of the theory of
state organization of a democratic and legal character.
The article stresses the fact that the academic heritage of the Western democracies is not
taken into account in Ukraine and its legal system is contradictory and does not correspond
to the Western values.
The authors present a position that explains that the cause of the political crisis in Ukraine is
the conflict of the legal norms determining the legal status and functions of state bodies. The
Parliament and other state bodies do not introduce international democratic traditions. The
above-mentioned increases the relevancy level of the research offered by the authors.
The methodology used by the authors has allowed establishing the characteristics of the
formation of legal consciousness of the contemporary English society, the formation of the
idea of the democratic, legal state and civil society as well as legal mechanisms for their
management in the practice of state establishment.
The authors have substantially analysed the theoretical generalization of the political process
in England by John Locke, stressed some of its aspects that have become the foundation of
further development of the separation of powers theory, the fundamental principle of
democratic state of legal character.
