Abstract
У роботі розкрито теоретичні основи, чинники та мотиви активізації нетарифного регулювання в глобальній торговельній системі на сучасному етапі розвитку міжнародної торгівлі. У рамках дослідження проаналізовано наслідки застосування нетарифних заходів та їх вплив на торгівлю країн та економіку в цілому.
Автором здійснено ґрунтовний аналіз розвитку нетарифного регулювання, його категоріального апарату та функцій. В роботі досліджено сучасну практику застосування нетарифних заходів регулювання міжнародної торгівлі і розкрито характерні особливості інституційного забезпечення нетарифного регулювання міжнародної торгівлі на глобальному рівні. У дисертації автором визначено залежність між кількістю випадків застосування нетарифних заходів та обсягом імпорту і середньою ставкою імпортного мита. Виявлено проблеми нетарифного регулювання зовнішньої торгівлі в Україні та надано пропозиції щодо його комплексного вдосконалення.
The thesis is devoted to the analysis of the theoretical foundations of non-tariff regulation of commodity exchange under conditions global trading system and problems, ways of improvement of non-tariff regulation of Ukrainian foreign trade.
The paper distinguishes two approaches to understanding the importance of non-tariff regulation of international trade - commercial and economic. The author defines essential difference between the concepts of "non-tariff measures" (non-tariff instruments that promote or hinder the development of trade) and "non-tariff barriers" (the non-tariff measures that only hinder the development of trade and for the most part is prohibited by multilaterally agreed rules of international trade).
The author improved the classification of non-tariff measures on the results of their application: measures that restrict exports/imports (technical, non-technical and procedural) and measures that promote exports/imports (organizational, technical, economic and procedural). The key functions of non-tariff regulation are defined: protectioning, stimulating, fiscal, regulatory and environmental.
The motifs of non-tariff measures usage were identified in the paper (economic, political and environmental) at different levels of regulation of international trade (national, regional, global). In practice, the grounds of non-tariff regulation of international trade are often complex.
The author defines the positive effects of the non-tariff measures on the country's foreign trade (provides trade growth, stimulates export potential, reduces operating costs, guarantee the quality of goods) and a negative impacts on international trade (prevents free trade, limits and discriminates importers, distorts the structure of trade etc.).
The thesis improved comprehensive description of field of practice, advantages and disadvantages of the methods of quantitative evaluation of the results of non-tariff measures regulating international trade: frequency (to determine the frequency of use of non-tariff measures by product group); the price differences (for determining tariff equivalents and evaluation of price changes caused by the use of non-tariff measures); econometric based on the price (to determine the level of prices of goods depending on the use of non-tariff measures) and the volume of goods (to assess the impact of non-tariff measures on exports and imports); simulation (to simulate the impact of non-tariff regulation tool for macroeconomic indicators, trade flows, prices, production in some spheres and sectors).
The author reveals the major characteristics of institutional support of non-tariff regulation of international trade at the global level and insists that the leading role in this process is given to the World Trade Organization.
Informational, analytical and legal assistance to the WTO in the establishment and maintenance of international trade regulatory framework and monitoring of its compliance provides a network of international governmental and non-governmental organizations: The United Nations Conference on Trade and Development, the World Customs Organization
, the International Organization of Legal Metrology, International organization for Standardization; International Chamber of Commerce, the International Union for the Protection of Natural Resources and others.
In the formation of global institutional infrastructure of non-tariff regulation the author defines two opposing tendencies: the desire of international organizations to collaborate more tightly with the WTO; efforts to preserve the autonomy and the possibility to influence in their sphere of their expertise.
Attention is focused on the fact that over the last decade, along with traditional non-tariff measures regulating international trade new types of measures are defined – procedural obstacles, more effective and also more subtle, leading to the formation of a new form of protectionism – non-tariff neoprotectionism. The thesis identifies factors in the formation of a new form of protectionism (economic, political, legal, environmental and social).
The author researches the current practice of non-tariff measures regulating international trade and defines the dependence between the number of cases of non-tariff measures and applications on imports and an average rate of import duty. The thesis proposed areas of comprehensive improvement of non-tariff regulation of foreign trade in Ukraine in the context of the proposed in the thesis key functions.
В работе раскрыты теоретические основы, факторы и мотивы активизации нетарифного регулирования в глобальной торговой системе на современном этапе развития международной торговли. В рамках исследования проанализированы последствия применения нетарифных мер и их влияние на торговлю и экономику в целом.
Автором осуществлен глубокий анализ развития нетарифного регулирования, его категориального аппарата и функций. В работе исследована современная практика применения нетарифных мер по регулированию международной торговли и раскрыты характерные особенности институционального обеспечения нетарифного регулирования международной торговли на глобальном уровне. В диссертации автором определена зависимость между количеством случаев применения нетарифных мер, объемом импорта и средней ставке импортной пошлины. Выявлены проблемы нетарифного регулирования внешней торговли в Украине и представлены предложения по его комплексному усовершенствованию.
