Адміністративно-правове регулювання державного резерву в Україні: поняття, особливості та принципи

Адміністративно-правове регулювання державного резерву в Україні є однією з основних складових національної безпеки та економічної стабільності держави. Державний резерв, як система стратегічних запасів, відіграє ключову роль у забезпеченні життєво важливих потреб країни під час надзвичайних ситуацій, таких як війна, природні катастрофи чи економічні кризи. Законодавча база для створення і управління резервами включає не лише внутрішні правові акти, але й міжнародні зобов’язання України.
Важливо зазначити, що у нинішніх умовах війни з Росією ефективне управління стратегічними запасами стало критичним для підтримки функціонування економіки та забезпечення потреб населення. Недоліки в адміністративно-правовому регулюванні потребують вдосконалення для адаптації до сучасних викликів.
Закон України «Про державний матеріальний резерв» визначає основні принципи функціонування державного резерву, включаючи його формування, зберігання та використання. Одним із ключових принципів є централізоване управління запасами, що здійснюється через Державне агентство резерву України, яке координує роботу з іншими центральними органами виконавчої влади. Однак, існують суттєві проблеми з оновленням та контролем за станом резервів, що часто призводить до їхнього зловживання або неефективного використання. Ситуація ускладнюється також браком чіткого контролю за поповненням запасів, особливо в умовах війни, коли потреби держави суттєво зростають. Необхідно вдосконалити механізми координації між державними структурами та забезпечити прозорість процесів управління.
Проблеми, що існують у нинішній системі, включають відсутність регулярного аудиту та неналежне оновлення запасів. У багатьох випадках державні ресурси можуть залишатися невикористаними або не готовими до застосування в кризових ситуаціях, через що держава стикається з додатковими труднощами. Непрозорість у процесах управління запасами створює передумови для корупційних схем, що є однією з найбільших загроз для ефективного функціонування системи державного резерву. На відміну від європейських країн, таких як Польща чи Швеція, де такі проблеми вирішуються через автоматизацію та відкритий доступ до інформації про стан резерву, Україна потребує системних реформ у цій сфері. Прозорість і регулярний моніторинг запасів повинні стати пріоритетом.
На додаток до проблем із прозорістю та аудитом, адміністративно-правова система управління державним резервом стикається з викликами в координації між різними державними органами. Чинне законодавство не передбачає чіткого механізму співпраці між Міністерством економіки, Державним агентством резерву та іншими структурами, що створює затримки в ухваленні рішень. Для підвищення ефективності управління різних видів резерву необхідно запровадити єдиний державний механізм координації між відомствами. Важливо впровадити електронні системи моніторингу та звітності, що дозволить мінімізувати ризики зловживань та прискорити процес прийняття рішень в умовах кризи. Досвід Європейського Союзу, де електронні системи управління резервом є нормою, може стати основою для подальшої модернізації української системи.
Таким чином, дослідження адміністративно-правового регулювання державного резерву в Україні дасть можливість не лише вдосконалити національну систему, але й підвищити її стійкість до зовнішніх та внутрішніх загроз, включаючи війну. Важливо також враховувати уроки, які Україна отримала під час збройної агресії, та адаптувати свої правові механізми для забезпечення максимальної готовності державних ресурсів до кризових ситуацій. Впровадження міжнародних стандартів управління та прозорості дозволить знизити корупційні ризики та забезпечити ефективне використання резерву. Це, своєю чергою, підвищить рівень захищеності населення і забезпечить економічну стабільність навіть у найскладніших умовах.
The administrative and legal framework governing Ukraine’s state reserve is a cornerstone of both national security and economic stability. As a system of strategic reserves, the state reserve plays a vital role in addressing the country's needs during emergencies, including war, natural disasters, or economic crises. The legal framework for establishing and managing reserves consists not only of domestic laws but also of Ukraine's international obligations. It is essential to recognize that, given the ongoing war with Russia, the efficient management of strategic reserves has become crucial for sustaining the economy and meeting the population’s needs. Existing shortcomings in administrative and legal regulation require significant improvements to adapt to current challenges.
The Law of Ukraine «On the State Material Reserve» outlines the core principles governing the state reserve, which include its formation, storage, and use. A key principle is centralized management, which is carried out through the State Agency for Reserves of Ukraine, in cooperation with other central executive bodies.
Despite this, there are significant issues surrounding the updating and oversight of reserves, often resulting in misuse or inefficient deployment. Furthermore, the lack of a clear mechanism for replenishing reserves, particularly during wartime when state demands are heightened, presents a serious challenge. There is a pressing need to improve coordination among state bodies and ensure transparency in management.
Several issues currently plague the system, including the absence of regular audits and the improper replenishment of reserves. In many instances, state resources may remain idle or unprepared for deployment during crises, causing additional strain on the state’s infrastructure. Non-transparent management processes create fertile ground for corruption, which poses one of the greatest threats to the effective functioning of the state reserve system. Unlike European countries such as Poland or Sweden, where issues like these are addressed through automation and open access to reserve status information, Ukraine’s system requires significant reform. Prioritizing transparency and regular monitoring is imperative.
Moreover, the administrative and legal system governing Ukraine’s state reserve faces further challenges with regard to coordination between different state agencies. Current legislation lacks a clear framework for cooperation between the Ministry of Economy, the State Agency for Reserves, and other government bodies,which causes delays in decision-making. To enhance the efficiency of managing various types of reserves, the implementation of a unified state coordination mechanism is necessary. Additionally, adopting electronic monitoring and reporting systems will help minimize the risk of misuse and accelerate decision-making during crises. The European Union’s experience, where electronic systems for reserve management are commonplace, offers a valuable blueprint for modernizing Ukraine’s system.
Therefore, studying the administrative and legal regulation of Ukraine's state reserve will not only help improve the national system but also increase its resilience to both external and internal threats, such as the ongoing war. The lessons learned from the armed conflict should inform adjustments to the country’s legal mechanisms, ensuring that state resources are always prepared for crisis scenarios. Incorporating international standards for management and transparency will mitigate corruption risks and facilitate the effective use of reserves. This, in turn, will bolster public protection and guarantee economic stability, even in the most challenging conditions.
Суб’єкти адміністративно-правового забезпечення використання засобів індивідуального бронезахисту

У даній статті досліджується поняття суб’єктів адміністративно-правового забезпечення використання засобів індивідуального бронезахисту.
Аналізуючи сучасні збройні конфлікти, особливо ті, які відбуваються на території нашої держави останні десять років можна зробити висновок, що більшість летальних випадків відбуваються саме через уламкові ураження. З початку проведення антитерористичної операції і до сьогодні Збройні Сили України, добровольчі формування, сили територіальної оборони та інші підрозділи часто відчувають дефіцит якісних сучасних засобів індивідуального бронезахисту. Відповідно до діючих нормативно-правових актів усіх військових, зокрема мобілізованих, держава зобов’язана забезпечувати формою, взуттям, спорядженням та іншими засобами речового та продовольчого забезпечення, згідно із встановленими нормами. Але деякі предмети спорядження/військової амуніції, у тому числі засоби індивідуального бронезахисту, мобілізовані та штатні представники сил безпеки та оборони купують самостійно (або отримують у вигляді благодійної допомоги) на заміну виданим.
З’ясовано, що суб’єкт адміністративного права являє собою загальну категорію, яка характеризує органи, що відповідають вимогам норми адміністративного права, тоді як суб’єкт адміністративно-правових відносин завжди конкретно визначений, він уже фактично вступив у певні адміністративно-правові відносини.
Адміністративно-правове забезпечення можна охарактеризувати як вплив суб’єктів державно-владних повноважень на суспільні відносини у сфері публічного управління за допомогою засобів адміністративного права. Cуб’єкт адміністративно-правового забезпечення – це орган, який має певні права та обов’язки, сформульовані в нормах адміністративного права, і може вступати в адміністративно-правові відносини.
Суб’єктами адміністративно-правового забезпечення використання засобів індивідуального бронезахисту можуть бути ті органи, які наділені відповідними повноваженнями та входять до складу сектору безпеки і оборони України. Особливістю діяльності цих органів у досліджуваній сфері є те, що порядок, підстави, способи забезпечення використання засобів індивідуального бронезахисту чітко регламентується правовими нормами, передусім адміністративного права.
This article examines the concept of subjects of administrativelegal support for the use of individual protective equipment. Analyzing modern armed conflicts, particularly those occurring in our country over the last ten years, one can conclude that most fatalities occur due to fragmentary injuries. Since the beginning of the anti-terrorist operation and up to the present, the Armed Forces of Ukraine, volunteer formations, territorial defense forces, and other units often experience a shortage of high-quality modern individual protective equipment.
According to current regulatory legal acts, the state is obliged to provide military personnel, including those mobilized, with uniforms, footwear, equipment, and other material and food supplies in accordance with established standards. However, some items of gear/military equipment, including individual protective equipment, are purchased independently by mobilized and regular members of security and defense forces (or received as charitable assistance) to replace what has been issued.
It has been clarified that a subject of administrative law represents a general category that characterizes the bodies that meet the requirements of administrative law norms, while a subject of administrative-legal relations is always specifically defined, having already entered into certain administrative-legal relations.
Administrative-legal support can be characterized as the influence of subjects with state-authority powers on social relations in the field of public administration through the means of administrative law. The subject of administrative-legal support is an organization that has certain rights and obligations outlined in the norms of administrative law and can enter into administrative-legal relations.
Subjects of administrative-legal support for the use of individual protective equipment may include those bodies endowed with appropriate powers and belonging to the security and defense sector of Ukraine. A notable feature of the activities of these bodies in the studied area is that the procedures, grounds, and methods for ensuring the use of individual protective equipment are clearly regulated by legal norms, primarily those of administrative law.

Criminological investigation of correlation between corruption and organized economic crime testifies that organized crime and corruption first of all endangers national security of Ukraine, its further development, ensuring constitutional system, proper functioning of all political-economic system. That is why not accidentally the Decrees of the President of Ukraine “On Complex Earmarked for a Specific Purpose Program for Fighting Criminality” and “On Complex Program in Preventing Criminality” define fighting organized crime and corruption in an economic sphere as one of priority directions. Detecting of organized crimes committed under not obvious circumstances is a complicated and multifactored. The necessity of quick and correct solving informational, methodological, tactical, psychological, technical and many other issues predetermined active participation of inquiry and search workers, the Security Service, militia, its operative detachments, the Procurator’s Office, experts, professionals, and the public. That is why a complex approach to fighting crime, including economic one, needs further development, also improvement in co-operation between all lawenforcement and controlling organs is needed. The work in this direction should be considered one of priorities
for state organs nowadays and in future.
Features of Pedagogical Technology of Teaching and Training of Police Officers in National Academy of Internal Affairs

The article shows some aspects of pedagogical technologies for training police cadets. Analyzed the Peculiarities of professional pedagogical activity in institution of higher education of Ukraine with special conditions of studying. In the process of writing the article (research) was analyzed the similar world experience of pedagogical activity of colleagues from similar educational institutions of other countries. Have been used different types of research, methods and current empirical data. In order to update the research, all explorative groups of cadets were differentiated by age, gender and educational characteristics (previous service in the Ministry of Internal Affairs or the Ministry of Defense of Ukraine, availability of special education, etc.)
Best International Practices of Combating Terrorism and Organised Crime by Special Units and Law Enforcement Agencies

Therefore, this unit as a component of the gendarmerie is built on the principle of a military unit. The gendarmerie, one of the few state institutions in France, has been in existence for over 200 years and has a status as a significant component of the country's armed forces and is an extremely important part of the police system. The gendarmerie is subordinated to the Ministry of Defense (on the authority of the Main Directorate), and on the ground - to the command of military districts. At the same time, the gendarmerie is at the operational disposal of the Ministry of Internal Affairs and the Ministry of Justice. Significant autonomy within the Armed Forces allows the gendarmerie to combine military functions with purely police and administrative ones. The difference between police and gendarmerie is that the police are civilian civil servants. They can wear civilian clothes and trade union and political freedoms. Gendarmes also have the status of servicemen and military ranks, always in uniform, not entitled to strike and are responsible for violations in accordance with military charters - from guardians to dismissal from service (for example, for the use of alcohol "in the performance of official duties" the gendarme is threatened arrest for up to 30 days).
The need for the creation of the Austrian Special Forces was conditioned by the urgency of taking measures to ensure the safety of the flow of emigrants of Jewish nationality from the former USSR since in autumn 1973 against them was committed serious terrorist act. Special unit "Cobra" enters the warehouse of the Ministry of Internal Affairs and has got a double subordination: through direct combat engagement to the head of public safety, and in relation to personnel issues and logistics - the central command of the gendarmerie of the Austrian Ministry of Internal Affairs.
Among the well-known British Special Political Service (Special Air Service, or SAS) is probably the best counterterrorism unit. Its component - Special Projects (SP) team - the main anti-terrorist squad. The Special Air Service and its Counter Revolutionary Warfare Squadron (CRW) unit, the Antirevolutionary Military Squadron, were founded in 1942. The feature of training SAS servicemen is to teach each soldier to possess all methods and means of combating terrorism. To achieve this, SAS trains all of its squadron through training cycles. Acquired skills are improved later in the SP-team's combat duties. The main thing in the work is the maximum approximation of training sessions to a real combat situation in the conduct of operations on the release of hostages, in the role of which are civilians. Anti-terrorist training of SAS and the development of practical measures for the release of hostages is facilitated by the fact that high-ranking members of the British Government, including the Prime Minister, are personally involved in it.
