    Трансформація адміністративно-правового статусу ІТ-підрозділів органів публічної влади в процесі цифрового відновлення України

    Статтю присвячено комплексному адміністративно-правовому аналізу трансформації правового статусу структурних підрозділів з питань інформаційних технологій (цифровізації) в органах публічної влади України в умовах повоєнного відновлення держави. Обґрунтовано, що сучасні процеси відбудови, які здійснюються з активним використанням цифрових інструментів та інформаційно-аналітичних систем, зумовлюють докорінну зміну ролі ІТ-підрозділів, що виходить за межі традиційного сприйняття їх як допоміжних або сервісних структур. У статті доведено, що чинна нормативна база, зокрема типові положення про структурні підрозділи, не повною мірою відповідає сучасним викликам реалізації масштабних цифрових проєктів відновлення, таких як екосистема DREAM (Digital Restoration Ecosystem for Accountable Management). Акцентовано увагу на необхідності переосмислення адміністративно-правового статусу ІТ-підрозділів шляхом переходу від моделі «технічного забезпечення» до моделі «стратегічного цифрового управління», що охоплює управління даними, контроль їх цілісності, забезпечення кібербезпеки та координацію міжвідомчої цифрової взаємодії. На основі аналізу доктринальних підходів до визначення елементів адміністративно-правового статусу (цільового, компетенційного та організаційно-структурного блоків) обґрунтовано необхідність їх перегляду з урахуванням специфіки цифрового відновлення України. Особливу увагу приділено ролі інституту заступників керівників органів влади з питань цифрового розвитку (CDTO) як ключових агентів інституційної трансформації та координаторів цифрових змін. Окремо досліджено вплив воєнного стану на зміст повноважень ІТ-підрозділів, зокрема у сфері захисту державних реєстрів, управління доступом до інформаційних ресурсів та адміністрування процедур, що мають юридично значущі наслідки у процесі відбудови. Доведено, що в умовах євроінтеграції адміністративно-правовий статус ІТ-підрозділів має бути гармонізований з вимогами права Європейського Союзу (GDPR, eIDAS, Interoperable Europe Act), що зумовлює запровадження функцій внутрішнього цифрового аудиту та комплаєнсу. Наукова новизна дослідження полягає у визначенні цифрового відновлення України як особливого адміністративно-правового режиму здійснення публічної влади, в межах якого ІТ-підрозділи виступають ключовими центрами управління змінами та гарантіями прозорості й підзвітності відбудовчих процесів. The article is devoted to a comprehensive administrative and legal analysis of the transformation of the legal status of structural units responsible for information technologies (digitalisation) within public authorities of Ukraine in the context of the country’s post-war recovery. It is substantiated that contemporary reconstruction processes, which are increasingly implemented through digital tools and integrated information and analytical systems, necessitate a fundamental rethinking of the role of IT units, extending far beyond their traditional perception as auxiliary or technical support structures. The study demonstrates that the existing regulatory framework, including standard regulations governing the activities of structural units, does not fully correspond to the current challenges associated with the implementation of large-scale digital recovery projects, such as the DREAM ecosystem (Digital Restoration Ecosystem for Accountable Management). Emphasis is placed on the need to transform the administrative and legal status of IT units by shifting from a “technical support” model to a model of “strategic digital governance”, encompassing data management, control over data integrity, cybersecurity, and coordination of interagency digital interaction. Based on an analysis of doctrinal approaches to the elements of administrative and legal status, namely the functional, competency-based, and organisationalstructural components, the necessity of their revision in light of Ukraine’s digital recovery is substantiated. Particular attention is paid to the role of deputy heads of public authorities for digital development (Chief Digital Transformation Officers, CDTOs) as key agents of institutional transformation and coordinators of digital change. The article also examines the impact of martial law on the scope of powers exercised by IT units, especially in the areas of protecting state registers, managing access to information resources, and administering procedures that produce legally significant consequences in the recovery process. It is argued that, within the framework of European integration, the administrative and legal status of IT units must be harmonised with EU legal standards (GDPR, eIDAS, Interoperable Europe Act), which objectively necessitates the introduction of internal digital audit and compliance functions. The scientific novelty of the study lies in conceptualising Ukraine’s digital recovery as a specific administrative and legal regime of exercising public authority, within which IT units act as key centres of change management and as guarantors of transparency and accountability in reconstruction processes.
