Abstract
На рівні Конституції України закріплено основоположні права людини і громадянина, але поряд з ними також мають нормативну регламентацію найбільш важливі обов’язки, що відповідно іменуються конституційними. Дана стаття присвячена розгляду практики виконання конституційних обов’язків в Україні. Визначено, що конституційним обов’язком є необхідний вид і міра поведінки особи, що має юридичне закріплення на найвищому рівні, передбачає досягнення суспільно корисної мети та забезпечується у разі невиконання юридичною відповідальністю. Автором було встановлено перелік конституційних обов’язків, досліджено їх сутнісні характеристики та визначено форму їх реалізації. Дослідження характеристик конституційних обов’язків людини і громадянина є значущим, оскільки це дозволяє встановити точні умови та порядок їх виконання, дослідити їх складові, суб’єктів, на кого покладається зобов’язання тощо. Визначення рис конституційних обов’язків є необхідним для дотримання правового режиму в державі та забезпечення точного виконання покладених обов’язків. На підставі даних статистики було оцінено дотримання одного із загальних обов’язків – неухильного дотримання законів України та непосягання на права та свободи інших осіб. Також прослідковано виконання податкового обов’язку, який має характер конституційного. Додатково автором визначено правове та соціальне значення встановлення та реалізації конституційних обов’язків людини і громадянина. Отримані результати, внаслідок проведеного дослідження можуть бути використані для популяризації правових положень, що є шляхом підвищення рівня загальної правосвідомості громадян. Додатково, даною статтею можливо привернути увагу громадськості до проблеми необхідності якісного і добросовісного виконання конституційних та інших юридичних обов’язків для розвитку держави і суспільства.
At the level of the Constitution of Ukraine, the fundamental rights of a person and a citizen are enshrined, but along with them, the most important duties, which are accordingly called constitutional, also have normative regulation. This article is devoted to consideration of the practice of fulfilling constitutional duties in Ukraine.It was determined that a constitutional duty is the necessary type and degree of behavior of a person, which has legal consolidation at the highest level, provides for the achievement of a socially useful goal and is ensured in case of non-fulfillment by legal responsibility.The author established a list of constitutional duties, researched their essential characteristics, and determined the form of their implementation. The study of the characteristics of the constitutional duties of a person and a citizen is significant, as it allows to establish the exact conditions and order of their fulfillment, to investigate their components, subjects, on whom the obligation is entrusted, etc. Determining the features of constitutional duties is necessary for compliance with the legal regime in the state and ensuring the accurate performance of assigned duties.On the basis of statistical data, compliance with one of the general obligations was assessed – strict compliance with the laws of Ukraine and non-infringement of the rights and freedoms of other persons. The fulfillment of the tax obligation, which is of a constitutional nature, was also monitored. In addition, the author defines the legal and social significance of the establishment and implementation of the constitutional duties of a person and a citizen.
The results obtained as a result of the conducted research can be used to popularize legal provisions, which is a way of increasing the level of general legal awareness of citizens. In addition, this article can draw the public's attention to the problem of the need for high-quality and conscientious performance of constitutional and other legal obligations for the development of the state and society.
