Abstract
У статті досліджено актуальність законодавства України у сфері електронного документообігу та автоматизації обліку в державному секторі. Проаналізовано відповідність чинного законодавства до сучасних технологій та міжнародних стандартів. Виявлено необхідність постійного оновлення нормативно-правової бази для забезпечення ефективного функціонування систем електронного документообігу та підвищення прозорості та ефективності управління державними фінансами. Особлива увага приділяється питанням безпеки, доступу до інформації та взаємодії різних інформаційних систем. Запропоновано конкретні рекомендації щодо вдосконалення законодавства для забезпечення ефективного функціонування електронного урядування та підвищення довіри громадян до державних послуг. Розглянуто питання адаптації законодавства до потреб суспільства і визначено перспективи розвитку нормативно-правового забезпечення у цій сфері.
The article provides an in-depth examination of the current legal framework regulating electronic document management and the automation of accounting processes within Ukraine’s public sector. Key legislative acts, such as the Law of Ukraine "On Electronic Documents and Electronic Document Flow" and the Law "On Accounting and Financial Reporting in Ukraine," as well as relevant government decrees and orders regulating the implementation of electronic document management systems (EDMS), are thoroughly analyzed. The study reveals that while the existing legal framework aligns with many international standards, including ISO 15489 (document management) and ISO 27001 (information security), the rapid advancement of technology necessitates continuous updates to the legislation. This will ensure the efficient functioning of EDMS, minimize security risks, and enhance the transparency of public administration.
In addition to the legislative analysis, the article emphasizes the methodological approach used to evaluate both normative and practical aspects of EDMS functioning. Special attention is given to the integration of governmental information systems, ensuring interoperability, protecting confidential data, and establishing effective channels for interdepartmental data exchange. The authors highlight the challenges of adapting the Ukrainian legal framework to technological realities, such as the implementation of advanced encryption standards, the development of electronic identification tools, and the unification of regulatory procedures.
The practical contribution of this study lies in proposing steps to harmonize Ukrainian legislation with contemporary international requirements, supporting the implementation of efficient e-governance and strengthening Ukraine’s digital transformation strategy. The article also outlines prospects for further development of the legal framework, considering societal demands, the European integration context, and the potential of emerging technologies such as blockchain and artificial intelligence. By addressing these aspects, the study underlines the importance of legal modernization in fostering citizen trust in electronic public services and improving accountability, efficiency, and openness of the public sector.
