Правові гарантії забезпечення прав і свобод маломобільних груп населення в сучасних умовах: теоретико-правовий аспект

Abstract
У статті розглянуто сучасний стан розвитку українського суспільства та держави, який характеризується необхідністю проведення теоретико-правового дослідження правових гарантій забезпечення прав і свобод маломобільних груп населення в реальних умовах. У дослідженні здійснено узагальнення наукових підходів щодо гарантій прав і свобод особи, під якими необхідно розуміти, по-перше, певні умови, за яких можлива найповніша та всебічна реалізація прав і свобод особи; по-друге, засоби, які ефективно забезпечують охорону та захист прав і свобод особи в разі їх незаконного порушення. Автором статті зазначено, що в системі гарантій прав і свобод людини та громадянина окреме місце відведено правовим гарантіям, які створюють необхідні юридичні умови для перетворення закріплених у законодавстві прав і свобод людини та громадянина з можливостей на реальність. Значну увагу приділено дослідженню правових гарантій забезпечення прав і свобод маломобільних груп населення в сучасних умовах як правових умов, засобів та способів, що визначають послідовний порядок дій певної категорії осіб щодо реалізації прав і свобод людини у спосіб та у формі, що закріплені міжнародним правом та чинним національним законодавством держави. Автор статті пропонує здійснити поділ цих гарантій на дві великі групи: нормативно-правові (як сукупність правових норм, за допомогою яких забезпечується реалізація, охорона і захист прав і свобод маломобільних груп населення в сучасних умовах) та організаційно-правові (сукупність державних органів та органів місцевого самоврядування, а також політичних партій і громадянських організацій, засобів масової інформації, міжнародних правозахисних організацій та їх діяльність у сфері правотворчості і правозастосування, спрямована на створення сприятливих умов для реального користування маломобільними групами населення своїми правами і свободами).
The article examines the current state of development of Ukrainian society and the state, which is characterized by the need to conduct a theoretical and legal study of legal guarantees of ensuring the rights and freedoms of low-mobility population groups in real conditions. The research summarizes the scientific approaches to the guarantees of the rights and freedoms of the individual, under which it is necessary to understand, firstly, certain conditions under which the most complete and comprehensive realization of the rights and freedoms of the individual is possible; secondly, means that effectively ensure the protection and protection of a person’s rights and freedoms in the event of their illegal violation. The author of the article states that in the system of guarantees of the rights and freedoms of a person and a citizen, a special place is given to legal guarantees that create the necessary legal conditions for transforming the rights and freedoms of a person and a citizen enshrined in legislation from possibilities into reality. Considerable attention is paid to the study of legal guarantees of ensuring the rights and freedoms of low-mobility population groups in modern conditions as legal conditions, means and methods that determine the consistent order of actions of a certain category of persons regarding the realization of human rights and freedoms in the manner and in the form established by international law and in force national legislation of the state. The author of the article proposes to divide these guarantees into two large groups: regulatory and legal (as a set of legal norms, which ensure the implementation, protection and protection of the rights and freedoms of low-mobility population groups in modern conditions) and organizational and legal (a set of state bodies and bodies local self-government, as well as political parties and civil organizations, mass media, international human rights organizations and their activities in the field of law-making and law enforcement, aimed at creating favorable conditions for the real use of their rights and freedoms by less mobile population groups).
