    Особливості визначення підслідності військових кримінальних правопорушень

    У статті досліджено особливості визначення підслідності у кримінальних провадженнях щодо військових кримінальних правопорушень в умовах воєнного стану та трансформації системи кримінальної юстиції України. Обґрунтовано, що правильне визначення підслідності є ключовою передумовою забезпечення ефективності досудового розслідування, його своєчасності, повноти та неупередженості, а також важливим елементом гарантування прав учасників кримінального провадження. Проаналізовано наукові підходи до розуміння підслідності як правової категорії та умови досудового розслідування. Встановлено, що у вітчизняній доктрині підслідність традиційно розглядається як сукупність встановлених законом ознак кримінального провадження, які визначають компетентний орган досудового розслідування. Підтримано підхід, відповідно до якого підслідність доцільно тлумачити як систему правил визначення уповноваженого органу, що дозволяє узгодити різні наукові позиції. Досліджено нормативне регулювання підслідності військових кримінальних правопорушень, передбачене ст. 216 КПК України. Встановлено, що формальна визначеність підслідності таких правопорушень за Державним бюро розслідувань є неповною через наявність винятків та колізій із положеннями, що визначають компетенцію Служби безпеки України. Особливу увагу приділено проблемі розмежування підслідності щодо кримінальних правопорушень, передбачених ст. 422 та ст. 435-1 КК України. Проаналізовано судову практику щодо визначення підслідності, а також її вплив на допустимість доказів у кримінальному провадженні. Встановлено, що порушення правил підслідності може поставити під сумнів допустимість доказів, однак не завжди автоматично тягне за собою їх визнання недопустимими. Виявлено неоднорідність правозастосовної практики щодо визначення органу досудового розслідування у провадженнях за ст. 435-1 КК України та наявність фактичної конкуренції між різними органами. Зроблено висновок про необхідність усунення законодавчих колізій та уточнення правил підслідності військових кримінальних правопорушень. Запропоновано внести зміни до ст. 216 КПК України з метою чіткого визначення компетенції органів досудового розслідування, зокрема шляхом виключення з підслідності Державного бюро розслідувань кримінальних правопорушень, передбачених ст. 422 та ст. 435-1 КК України. Обґрунтовано, що такі зміни сприятимуть підвищенню правової визначеності та ефективності кримінального провадження. The article examines the features of determining the subject of investigation in criminal proceedings regarding military criminal offenses under martial law and the transformation of the criminal justice system of Ukraine. It is substantiated that the correct determination of the subject of investigation is a key prerequisite for ensuring the effectiveness of the pre-trial investigation, its timeliness, completeness and impartiality, as well as an important element of guaranteeing the rights of participants in criminal proceedings. The scientific approaches to understanding the subject of investigation as a legal category and the conditions of the pre-trial investigation are analyzed. It is established that in the domestic doctrine, subject of investigation is traditionally considered as a set of legally established features of criminal proceedings that determine the competent body of the pre-trial investigation. The approach is supported, according to which subject of investigation should be interpreted as a system of rules for determining the authorized body, which allows to reconcile different scientific positions. The normative regulation of the subject of investigation of military criminal offenses, provided for in Article 216 of the Code of Criminal Procedure of Ukraine, is investigated. It was established that the formal certainty of the subjectivity of such offenses under the State Bureau of Investigation is incomplete due to the presence of exceptions and conflicts with the provisions defining the competence of the Security Service of Ukraine. Particular attention is paid to the problem of delimiting subjectivity for criminal offenses provided for in Art. 422 and Art. 435-1 of the Criminal Code of Ukraine. The judicial practice on determining subjectivity, as well as its impact on the admissibility of evidence in criminal proceedings, was analyzed. It was established that violation of the rules of subjectivity may cast doubt on the admissibility of evidence, but does not always automatically entail their recognition as inadmissible. The heterogeneity of law enforcement practice on determining the pre-trial investigation body in proceedings under Art. 435-1 of the Criminal Code of Ukraine and the presence of actual competition between different bodies were revealed. The conclusion was made on the need to eliminate legislative conflicts and clarify the rules of subjectivity of military criminal offenses. It was proposed to amend Art. 216 of the Criminal Procedure Code of Ukraine in order to clearly define the competence of pre-trial investigation bodies, in particular by excluding from the jurisdiction of the State Bureau of Investigation of Criminal Offenses, provided for in Art. 422 and Art. 435-1 of the Criminal Code of Ukraine. It is substantiated that such changes will contribute to increasing legal certainty and efficiency of criminal proceedings.

    Право на захист у правових позиціях Верховного Суду

    Метою даної статті є наведення окремих правових позицій Верховного суду в кримінальному провадженні, які являються собою висновки щодо застосування норм, що передбачають право на захист. Необхідність зазначеного обумовлена тим, що висновки щодо застосування норм права, викладені у постановах Верховного Суду, враховуються іншими судами при застосуванні таких норм права. Таким чином, законодавством передбачено обов’язковість правових позицій Верховного Суду для інших судів під час застосування ними відповідних норм права в ході здійснення правосуддя. Так, Верховний Суд в такий спосіб забезпечує однакове застосування норм права судами різних спеціалізацій у порядку та спосіб, визначені процесуальним законом. В даному випадку такий механізм забезпечення однакового застосування норм права судами закріплений у Кримінальному процесуальному кодексі України й узгоджується з Законом України «Про судоустрій і статус суддів». В даній статті, не маючи на меті здійснювати дослідженні правової природи позицій (висновків щодо застосування норм права) Верховного Суду, все-таки відзначимо наступне. З-поміж поодиноких визначень «правових позицій/висновків щодо застосування норм права Верховного Суду», наводимо одних із них, який, на наше переконання, досить повно характеризує дане поняття: «Правова позиція Верховного Суду в кримінальному провадженні – це викладений у постанові найвищого органу у системі судоустрою України за наслідками перевірки правосудності судового рішення погляд загальнообов’язкового під час розв’язання аналогічних справ характеру щодо інтерпретації кримінально-правових та кримінальних процесуальних норм до встановлених обставин кримінального провадження, у якому теоретично обґрунтовані взірці способів вирішення правових колізій, долання прогалин у правовому регулюванні, а також створені судові норми, завдяки чому досягається єдність та стійкість судової практики» [1, с. 172]. Наразі ж пропонуємо низку наступних правових позицій Верховного Суду щодо застосування норм права, які регламентують право на захист, дотримання яких судами має сприяти формуванню єдиної судової практики та мінімізації порушень права на захист. The purpose of this article is to present certain legal positions of the Supreme Court in criminal proceedings, which are conclusions regarding the application of norms providing for the right to defense. The necessity of the above is due to the fact that the conclusions regarding the application of legal norms set forth in the Supreme Court’s rulings are taken into account by other courts when applying such legal norms. Thus, the legislation provides for the binding legal positions of the Supreme Court for other courts when they apply the relevant norms of law in the course of administering justice. The Supreme Court in this way ensures the equal application of legal norms by courts of various specializations in the order and manner determined by the procedural law. In this case, such a mechanism for ensuring the uniform application of legal norms by courts is enshrined in the Criminal Procedure Code of Ukraine and is consistent with the Law of Ukraine “On the Judicial System and the Status of Judges”. In this article, without aiming to investigate the legal nature of the positions (conclusions regarding the application of legal norms) of the Supreme Court, we nevertheless note the following. Among the individual definitions of “legal positions/conclusions regarding the application of the rules of the Supreme Court”, we cite one of them, which, in our opinion, quite fully characterizes this concept: «The legal position of the Supreme Court in criminal proceedings is the view set out in the resolution of the highest body in the judicial system of Ukraine as a result of the review of the justice of the court decision, which is mandatory when solving similar cases regarding the interpretation of criminal law and criminal procedural norms to the established circumstances of criminal proceedings , in which models of methods of resolving legal conflicts, overcoming gaps in legal regulation are theoretically substantiated, and judicial norms are created, thanks to which the unity and stability of judicial practice is achieved» [1, с. 172]. Currently, we offer a number of the following legal positions of the Supreme Court regarding the application of legal norms that regulate the right to defense, the observance of which by the courts should contribute to the formation of uniform judicial practice and the minimization of violations of the right to defense.
