    Зарубіжний досвід реалізації адміністративно-правового статусу антикорупційних суб’єктів

    У статті досліджено досвід реалізації адміністративно-правового статусу суб’єктів, діяльність яких спрямована на реалізації заходів щодо протидії корупції. Світовий досвід свідчить, що високі соціальні стандарти життя, стрімкі темпи економічного розвитку країни напряму пов’язані із ефективним запровадженням та реалізацією заходів щодо запобігання та протидії корупції. Висвітлено статистичні показники діяльності органів публічної влади в сфері протидії корупції. Наведено основні тенденції та ключові риси створення і функціонування антикорупційних суб’єктів в зарубіжних країнах. Встановлено, що нині в країнах з високим рівнем протидії корупції (Канада, Франція, Данія, Німеччина) застосовуються різні підходи (моделі), але з єдиною метою – протидія корупції. Розкрито систему органів зарубіжних країни, діяльність яких спрямована на реалізації заходів щодо протидії корупції, розкрито основні напрями їх діяльності. Встановлено, що сучасна система антикорупційних органів включає в себе декілька рівнів антикорупційних суб’єктів, які забезпечують реалізацію антикорупційних заходів, здійснюють моніторинг корупційних проявів у відповідній країні та за кордоном. Водночас встановлено, що ефективність антикорупційних механізмів перш за все залежить від прозорості базових положень взаємодії держави суспільства та бізнесу; переліком антикорупційного «інструментарія», який насамперед обумовлений суспільними традиціями та історією (Данія). Проаналізований позитивний досвід діяльності антикорупційних суб’єктів Канади, Франції, Данії, Німеччини, Румунії. Теоретично обґрунтовано, що позитивний зарубіжний досвід запобіганні та протидії корупції при всій специфіці системи їх державного управління становить певний інтерес для України і може бути використаним у практичній діяльності Національного агентства з питань запобігання корупції. The article examines the experience of implementing the administrative and legal status of entities whose activities are aimed at implementing measures to combat corruption. World experience shows that high social standards of living, rapid rates of economic development of the country are directly related to the effective introduction and implementation of measures to prevent and combat corruption. The statistical indicators of the activity of public authorities in the field of anti-corruption are highlighted. The main trends and key features of the creation and functioning of anti-corruption entities in foreign countries are given. It has been established that currently in countries with a high level of anti-corruption (Canada, France, Denmark, Germany) different approaches (models) are used, but with a single goal – anti-corruption. The system of bodies of foreign countries, whose activities are aimed at the implementation of anti-corruption measures, has been revealed, and the main directions of their activities have been revealed. It was established that the modern system of anti-corruption bodies includes several levels of anti-corruption entities that ensure the implementation of anti-corruption measures, monitor corruption manifestations in the respective country and abroad. At the same time, it was established that the effectiveness of anti-corruption mechanisms primarily depends on the transparency of the basic provisions of the interaction between the state, society and business; the list of anti-corruption “toolkit”, which is primarily determined by social traditions and history (Denmark). The positive experience of anti-corruption entities in Canada, France, Denmark, Germany, and Romania was analyzed. It is theoretically substantiated that positive foreign experience in preventing and countering corruption with all the specifics of their public administration system is of certain interest to Ukraine and can be used in the practical activities of the National Agency for the Prevention of Corruption.

    Трансформація законодавчих пріоритетів у сфері реабілітації ветеранів США: від компенсаторної моделі до комплексної системи відновлення

    Стаття присвячена аналізу трансформації законодавчих пріоритетів у сфері медичної та психологічної реабілітації військовослужбовців і ветеранів у Сполучених Штатах Америки протягом періоду від середини ХХ століття до сучасності. На відміну від традиційних хронологічних оглядів нормативних актів, дослідження застосовує проблемно-аналітичний підхід, спрямований на виявлення причинно-наслідкових зав'язків між змінами характеру збройних конфліктів, суспільними викликами та законодавчими відповідями. Основна увага приділяється трьом ключовим векторам трансформації американського законодавства. По-перше, аналізується еволюція пріоритетів від виключно соматичних ушкоджень до визнання психічного здоров’я як рівноцінної, а часом і домінуючої проблеми реабілітації. Показано, як зміна характеру воєнних конфліктів від масштабних міждержавних воєн до затяжних антитерористичних операцій детермінувала законодавчі інновації у сфері психологічної підтримки ветеранів. По-друге, досліджується перехід від уніфікованих стандартизованих підходів до персоналізованих стратегій реабілітації, що відображає ширші тенденції розвитку пацієнтоцентричної медицини. По-третє, аналізується процес подолання фрагментарності правового регулювання через кодифікацію норм, створення міжвідомчих координаційних механізмів та розробку спільних клінічних стандартів. Дослідження демонструє, що американське законодавство розвивалося переважно реактивно, як серія відповідей на гострі соціальні кризи, що має як позитивні наслідки (чутливість до суспільних настроїв), так і негативні (запізнілість втручань). Критичний аналіз виявляє значні обмеження законодавчих інтервенцій: попри масштабні фінансові вливання та численні програми, проблеми психічного здоров’я ветеранів залишаються далекими від повного вирішення. Стаття спростовує поширене уявлення про американську модель як зразок для механічного копіювання, натомість пропонуючи розглядати її як приклад еволюції через постійне зіткнення із викликами. Для інших держав важливим є не пряме запозичення законодавчих рішень, а засвоєння загальних принципів: комплексності підходу, визнання психічного здоров’я пріоритетом, персоналізації втручань та міжвідомчої координації. This article analyzes the transformation of legislative priorities in the field of medical and psychological rehabilitation of military personnel and veterans in the United States from the mid-20th century to the present. Unlike traditional chronological reviews of regulatory acts, the study employs a problem-analytical approach aimed at identifying causal relationships between changes in the nature of armed conflicts, societal challenges, and legislative responses. Primary attention is devoted to three key vectors of transformation in American legislation. First, the evolution of priorities from exclusively somatic injuries to the recognition of mental health as an equivalent, and sometimes dominant, rehabilitation concern is analyzed. The study demonstrates how the changing nature of military conflicts – from large-scale interstate wars to protracted counterterrorism operations – determined legislative innovations in the sphere of psychological support for veterans. Second, the transition from unified standardized approaches to personalized rehabilitation strategies is examined, reflecting broader trends in the development of patient-centered medicine. Third, the process of overcoming fragmentation in legal regulation through codification of norms, creation of interagency coordination mechanisms, and development of joint clinical standards is analyzed.The research demonstrates that American legislation developed predominantly reactively, as a series of responses to acute social crises, which has both positive consequences (sensitivity to public sentiment) and negative ones (delayed interventions). Critical analysis reveals significant limitations of legislative interventions: despite massive financial investments and numerous programs, veterans’ mental health problems remain far from fully resolved.The article refutes the widespread perception of the American model as a template for mechanical replication, instead proposing to view it as an example of evolution through constant confrontation with challenges. For other nations, what matters is not direct borrowing of legislative solutions, but adoption of general principles: comprehensiveness of approach, recognition of mental health as a priority, personalization of interventions, and interagency coordination.
