    Врегулювання спорів про майно та власність у зоні конфлікту: правовий статус тимчасово окупованих територій

    Проведено аналіз питання врегулювання спорів про майно та власність на тимчасово окупованих територіях у контексті збройних конфліктів. Автори досліджують правовий статус такої території та вплив такого статусу у вирішенні питаннь щодо власності. У статті аналізується міжнародні правила, включаючи Женевські конвенції та Додаткові протоколи до них, які регулюють захист цивільного населення та його майна в умовах конфлікту. Також досліджуються спеціальні механізми, включаючи роль міжнародних організацій у вирішенні спорів та відновленні порядку на окупованих територіях. Наголошено, про важливість дотримання принципів прав людини та міжнародного гуманітарного права для захисту прав та інтересів громадянського населення в умовах конфлікту. Розглянуті приклади з практики, дають підстави стверджувати про необхідність розробки та застосування ефективних механізмів врегулювання спорів та відновлення порушених прав у контексті тимчасово окупованих територій. Особлива увага приділяється ролі міжнародних правових інструментів у врегулюванні подібних ситуацій, зокрема, Женевським конвенціям та Додатковим протоколам до них, які визначають права та обов’язки сторін конфлікту та забезпечують захист цивільного населення. Розглянуто та досліджено, як саме ці міжнародні норми впливають на регулювання питань власності та майна. Крім того, висвітлюється та підтверджується важливість участь міжнародних організацій у вирішенні таких спорів та відновленні стабільності на окупованих територіях. Аналізується їхня роль у сприянні дотриманню принципів прав людини та міжнародного гуманітарного права, що є ключовим для забезпечення безпеки та захисту прав громадян в умовах конфлікту. Можна констатувати, що на сьогодні існує необхідність у комплексному підході до вирішення питань власності та майна на тимчасово окупованих територіях, який базується на принципах міжнародного права та сприяє відновленню правового порядку та захисту прав людини в умовах збройних конфліктів. Обґрунтовано важливість дотримання принципів прав людини та міжнародного гуманітарного права як основи для захисту прав та інтересів громадянського населення в умовах конфлікту. Визначаються основні проблеми та виклики, які виникають при вирішенні питань власності в зоні тимчасової окупації, і запропоновано можливі шляхи їх вирішення. An analysis of the settlement of disputes over property and ownership in temporarily occupied territories in the context of armed conflicts has been carried out. The authors examine the legal status of such territory and the impact of such status in resolving property issues. The article analyzes international rules, including the Geneva Conventions and their Additional Protocols, which regulate the protection of the civilian population and their property in conflict. Special mechanisms are also being explored, including the role of international organizations in resolving disputes and restoring order in the occupied territories. The importance of observing the principles of human rights and international humanitarian law to protect the rights and interests of the civilian population in conflict conditions was emphasized. The considered examples from practice give grounds for asserting the need to develop and apply effective mechanisms for settling disputes and restoring violated rights in the context of temporarily occupied territories. Special attention is paid to the role of international legal instruments in the settlement of similar situations, in particular, the Geneva Conventions and Additional Protocols to them, which determine the rights and obligations of the parties to the conflict and ensure the protection of the civilian population. It has been considered and researched how exactly these international norms affect the regulation of property and property issues. In addition, the importance of the participation of international organizations in resolving such disputes and restoring stability in the occupied territories is highlighted and confirmed. Their role in promoting compliance with the principles of human rights and international humanitarian law, which is key to ensuring security and protecting the rights of citizens in conflict, is analyzed. It can be stated that today there is a need for a comprehensive approach to solving property and property issues in the temporarily occupied territories, which is based on the principles of international law and contributes to the restoration of legal order and the protection of human rights in the conditions of armed conflicts. The importance of observing the principles of human rights and international humanitarian law as a basis for protecting the rights and interests of the civilian population in conflict conditions is substantiated. The main problems and challenges that arise when solving property issues in the zone of temporary occupation are determined, and possible ways to solve them are proposed.

    Національне законодавство у сфері захисту авторських прав на програмне забезпечення зі штучним інтелектом: проблемні питання та шляхи вдосконалення

    Стаття присвячена дослідженню проблемних аспектів чинного законодавства України у сфері захисту авторських прав на програмне забезпечення зі штучним інтелектом та формулюванню конкретних пропозицій щодо його вдосконалення. Актуальність теми зумовлена стрімким зростанням масштабів використання генеративного штучного інтелекту: за оцінками Gartner, вже у 2022 році ШІ створював близько 10% усього цифрового контенту у світі, що свідчить про нагальну потребу в правовому регулюванні. Встановлено, що традиційна модель охорони комп’ютерних програм як літературних творів, закріплена у Цивільному кодексі України та Законі України «Про авторське право і суміжні права», попри відповідність міжнародним стандартам, є недостатньою для регулювання об’єктів, що автономно генеруються системами штучного інтелекту без безпосередньої творчої участі людини. Запровадження статтею 33 зазначеного Закону права sui generis на такі об’єкти є першим у світі прикладом спеціального законодавчого режиму їх охорони, однак чинна редакція містить низку суттєвих недоліків. Окремо досліджено конфлікт між правами, наданими українським законодавством, та умовами договорів із глобальними ШІ-платформами, які фактично знецінюють ці права через широкі безвідкличні ліцензії. Проаналізовано досвід Євросоюзу – Регламент 2024/1689 (EU AI Act) та Директиву 2019/790/ ЄС (DSM), як орієнтир для реформування національного законодавства, а також розглянуто двоетапний план гармонізації з acquis ЄС, що передбачає спочатку запровадження м’яких регуляторних інструментів, а згодом ухвалення національного закону про штучний інтелект. За результатами дослідження запропоновано сім шляхів удосконалення: заміна критерію охороноздатності на «індивідуальний характер» за аналогією з правом ЄС; запровадження добровільної державної реєстрації; обмеження обсягу охорони до захисту від дослівного копіювання; обов’язкове маркування ШІ-об’єктів спеціальним символом; законодавче визначення переліку виключених об’єктів; врегулювання конфлікту з платформними угодами; поетапна гармонізація з acquis ЄС. The article examines the problematic aspects of current Ukrainian legislation in the field of copyright protection for artificial intelligence software and formulates concrete proposals for its improvement. The relevance of the topic is driven by the rapid growth in the use of generative artificial intelligence: according to Gartner estimates, as early as 2022 AI was generating approximately 10% of all digital content worldwide, underscoring the urgent need for adequate legal regulation. It is established that the traditional model of protecting computer programs as literary works, enshrined in the Civil Code of Ukraine and the Law of Ukraine «On Copyright and Related Rights», despite its compliance with international standards, is insufficient to regulate objects autonomously generated by artificial intelligence systems without direct human creative participation. The introduction of the sui generis right for such objects under Article 33 of the said Law represents the world’s first example of a special legislative protection regime; however, the current version contains a number of significant shortcomings. A separate focus is placed on the conflict between rights granted under Ukrainian law and the terms of agreements with global AI platforms, which effectively devalue those rights through broad irrevocable licences. The European Union’s experience – Regulation 2024/1689 (EU AI Act) and Directive 2019/790/EU (DSM), is analysed as a benchmark for reforming national legislation, and a twostage harmonisation roadmap with EU acquis is considered, envisaging first the introduction of soft regulatory instruments and subsequently the adoption of a national law on artificial intelligence. Based on the findings, seven avenues for legislative improvement are proposed: replacing the protectability criterion with «individual character» by analogy with EU law; introducing voluntary state registration; limiting the scope of protection to literal copying only; mandatory labelling of AI-generated objects with a special symbol; legislative definition of a list of excluded objects; resolution of the conflict with platform agreements; and phased harmonisation with EU acquis.
