Digital technologies in many sectors are at the core of production strategies. Their transformative power is changing traditional business models, production chains and processes, and driving new products and services, platforms and innovations. Digital technologies in Ukraine should be available both in terms of organizational and technical access to the relevant digital infrastructures and from the financial and economic point of view, that is, by creating conditions and incentives that will encourage businesses to digitalize. The result of such activities will be the modernization of the economy, its recovery, and increased competitiveness. The digital economy involves the introduction of digital technology in all areas, namely: production, education, medicine, tourism, social sphere. Spheres of life that are modernized with the help of "digital" technologies become much more efficient and create new value and quality, which very often leads to a complete transformation of the old system (Zhukova). Analysis of recent studies and publications. The problems of development of the digital economy and the formation of the information society are actively discussed in the domestic scientific literature, in particular in the works of R. Avdeyev, F. Gurov, L. Kit, S. Kolyadenko, D. Makovskyi, I. Malik, N. Meshko, I. Melyukhin, V. Pylypchuk, A. Prokofyev, Ye. Putilova, O. Ryzhenko. The authors substantiate the main conceptual categories and methodological approaches to the definition of the basic components of the modern model of socio-economic development and ways of implementing digital economy tools in the economic environment. At the same time, the theoretical understanding and scientific justification of the issues of informatization of society is the subject of scientific discussion by foreign researchers. R. Inclar, R. Cleo, A. Krimes, T. Nibel, J. Wright have made significant contributions to the development and implementation of innovative digital strategies. S. Haller, M. Hague and other scientists. However, many aspects of the impact of the digital economy on the institutional status of the state remain unexplored. Враховуючи, що в різних країнах назва цього інституту відрізняється, використовувався доречний на думку автора узагальнюючий термін – віртуальне дипломатичне представництво. З огляду на світову практику утворення віртуальних дипломатичних представництв було виокремлено основні випадки, у яких країни вирішують реалізовувати свою дипломатичну присутність саме в такій формі. З’ясовано особливості функціонування інституту віртуальних дипломатичних представництв Сполучених Штатів Америки (наприклад, в Ірані, Сан Марино, Республіці Сейшельські острови, Мальдівській Республіці тощо). Визначено відмінність Віртуального посольства США в Ірані від решти віртуальних посольств (Virtual Embassy) та інших віртуальних представництв (Virtual Presence Post). Здійснено огляд передового сінгапурського досвіду у досліджуваному питанні, як такого, що найбільше відповідає вітчизняним поки ще декларативним новаціям. У багатьох іноземних країнах Сінгапуром створенні посольства із резиденцією посла в Міністерстві закордонних справ Сінгапуру, зокрема такий формат посольства функціонує і в Україні. У статті висвітлюється позиція Міністра закордонних справ України Дмитра Кулеби, а також вітчизняних науковців щодо перспектив впровадження таких інституцій в Україні. У прийнятому 7 червня 2018 році Законі України «Про дипломатичну службу» запроваджено новий вид закордонної дипломатичної установи – Посольства України з резиденцією Надзвичайного і Повноважного Посла України в Києві. Однак аналіз чинного законодавства України дає підстави вважати, що правове забезпечення діяльності інституту «віртуальних дипломатичних представництв» в Україні наразі є недостатнім і не передбачає реального механізму реалізації цієї новації. Доказом чого слугує і відсутність створених таких інституцій серед закордонних дипломатичних установ України. Тому автором акцентується увага на нагальній необхідності законодавчого врегулювання питань, пов’язаних із утворенням та функціонуванням Посольств України з резиденцією Посла України в Києві. The scientific article analyses the current global trends of digital transformation in the field of diplomatic and consular relations, especially regarding the creation of a virtual diplomatic mission. The name of this institution differs in different countries, so the author decided to use an appropriate in his opinion generalizing term – virtual diplomatic mission. The main cases in which countries decide to implement their diplomatic presence in this form, based on the world practice of establishing virtual diplomatic missions, were identified. The peculiarities of the functioning of the institute of virtual diplomatic missions of the United States of America (for example, in Iran, San Marino, the Republic of Seychelles, the Republic of Maldives, etc.) are clarified. The difference between the US Virtual Embassy in Iran and other Virtual Embassies and virtual offices (Virtual Presence Post) is determined. The advanced Singaporean experience in the researched question is analyzed as such, which most fully corresponds to domestic innovations. In many foreign countries Singapore has established offices with the residence of the mission in the Ministry of Foreign Affairs of Singapore. Such format of representation operates in Ukraine too. The article considers the position of the Minister for Foreign Affairs of Ukraine Dmytro Kuleba and Ukrainian scientists on the prospects for the introduction such institutions in Ukraine The Law of Ukraine “On Diplomatic Service” adopted on June 7, 2018 provided for a new type of foreign diplomatic mission – the Embassy of Ukraine with the residence of the Ambassador Extraordinary and Plenipotentiary of Ukraine in Kyiv. However, the analysis of the current legislation of Ukraine gives grounds to believe that the legal support of the institution of "virtual diplomatic missions" in Ukraine is currently insufficient and does not provide a real mechanism for implementing this innovation. Proof of this is the lack of such institutions among foreign diplomatic missions of Ukraine. The article analyses the current legislation of Ukraine in the regulation of the diplomatic service, primarily related on the organization and functioning of foreign diplomatic institutions of Ukraine. The author explores the main innovations in the field of diplomatic service, in particular in the context of changes in the conceptual and categorical apparatus, system and elements of the diplomatic service, approaches to the organization and functioning of foreign diplomatic institutions of Ukraine. In the process of thorough analysis of the legislation of Ukraine, certain shortcomings in the current Law of Ukraine «On Diplomatic Service» and the Regulations on Foreign Diplomatic Institutions of Ukraine were identified, which in the future may cause problems in the application of law. The current state of the network of foreign diplomatic institutions of Ukraine (embassies, consulates and missions to international organizations) and the prospects for further expansion of Ukraine‘s diplomatic presence in the world is shown. Based on the norms of international agreements, legislative and by-laws of Ukraine are described the procedure for the establishment and placement of foreign diplomatic institutions in Ukraine, the procedure for appointing their heads and outlining the functions entrusted to foreign institutions of Ukraine. Attention is also focused on an interesting novelty of the Law of Ukraine «On Diplomatic Service» — the introduction of a new type of foreign diplomatic institution — the Embassy of Ukraine with the residence of the Ambassador Extraordinary and Plenipotentiary of Ukraine in Kyiv. Although this norm exists only in the theoretical plane and has not been implemented in practice, but the Minister for Foreign Affairs of Ukraine Dmytro Kuleba sees great new prospects in this. Based on the results of the study, were singled out the main directions in which the reform of foreign institutions of Ukraine is carried out, as well as the author’s vision of the possible reasons that led to this process was expressed.Item Особливості проходження державної служби працівниками закордонних дипломатичних установ України(Центральноукраїнський державний педагогічний університет імені Володимира Винниченка, 2021) Кожура, Людмила Олександрівна; Kozhura, Liudmyla; Маркарян, Марина Валеріївна; Markarian, MarynaУ даній статті розкрито особливості проходження державної служби працівниками закордонних дипломатичних установ України. У даній статті розкрито особливості проходження державної служби працівниками закордонних дипломатичних установ України. Визначено, що проходження державної служби працівниками закордонних дипломатичних установ України характеризується такими основними особливостями: 1) нормативно-правовою основою регулювання суспільних відносин щодо предмету дослідження є закони України «Про державну службу» та «Про дипломатичну службу»; 2) дипломатична служба є особливим видом державної служби, що належить до публічної служби; 3) при визначенні особливостей проходження державної служби працівниками закордонних дипломатичних установ України потрібно відмежовувати такі поняття, як «адміністративний службовець» та «дипломатичний службовець», що відповідають родовому поняттю «посадові особи дипломатичної служби»; 4) подвійна система рангів: дипломатичним службовцям присвоюється дипломатичний ранг, адміністративним – ранг державного службовця; 5) наявність привілеїв та імунітетів у працівників закордонних дипломатичних установ України, що встановлені та гарантуються нормами міжнародного та внутрішньодержавного права України та країни перебування; 6) під час проходження дипломатичної служби працівниками закордонних дипломатичних установ України відбувається періодична ротація, тобто планове заміщення посад дипломатичної служби в органах дипломатичної служби посадовими особами дипломатичної служби; 7) розширеній перелік підстав припинення державної служби працівниками закордонних дипломатичних установ України, на відміну від державних службовців інших державних органів. Виділяється три різновиди посад в органах дипломатичної служби, а саме: дипломатичні посади, адміністративні посади та посади працівників, які виконують функції з обслуговування, що загалом значною мірою впливає на порядок та умови зайняття посади, особливості перебування на ній та процедуру припинення трудових відносин. З урахуванням доктринальних досліджень вітчизняних науковців та на підставі чинного законодавства України, що регулює питання проходження державної та дипломатичної служби виокремлено основні складники проходження державної служби посадовими особами дипломатичної служби закордонних дипломатичних установ України. This article reveals the specifics of public service by employees of foreign diplomatic institutions of Ukraine. It was determined that the completion of public service by employees of foreign diplomatic institutions of Ukraine is characterized by the following main features: 1) the normative and legal basis for the regulation of public relations in rel ation to the subject of the study are the laws of Ukraine "On State Service" and "On Diplomatic Service"; 2) diplomatic service is a special type of public service belonging to the public service; 3) when determining the specifics of public service by employees of foreign diplomatic institutions of Ukraine, it is necessary to distinguish such concepts as "administrative employee" and "diplomatic employee", which correspond to the generic concept of "diplomatic service official"; 4) a dual system of ranks: diplomatic officers are assigned the diplomatic rank, administrative officers are assigned the rank of civil servant; 5) availability of privileges and immunities for employees of foreign diplomatic institutions of Ukraine, which are established and guaranteed by the norms of international and domestic law of Ukraine and the host country; 6) during diplomatic service, employees of foreign diplomatic institutions of Ukraine undergo periodic rotation, i.e. planned replacement of diplomatic service positions in diplomatic service bodies by diplomatic service officials; 7) an expanded list of grounds for termination of public service by employees of foreign diplomatic institutions of Ukraine, in contrast to civil servants of other state bodies. There are three types of positions in the bodies of the diplomatic service, namely: diplomatic positions, administrative positions, and positions of employees who perform service functions, which in general significantly affects the order and conditions of occupying the position, the features of staying in it, and the procedure for terminating employment relations. The authors have established the characteristics of the development of state and legal views of the Protestants and in particular Independents and Levellers as well as the conceptual formation of the theory of state organization of a democratic and legal character. The article stresses the fact that the academic heritage of the Western democracies is not taken into account in Ukraine and its legal system is contradictory and does not correspond to the Western values. The authors present a position that explains that the cause of the political crisis in Ukraine is the conflict of the legal norms determining the legal status and functions of state bodies. The Parliament and other state bodies do not introduce international democratic traditions. The above-mentioned increases the relevancy level of the research offered by the authors. The methodology used by the authors has allowed establishing the characteristics of the formation of legal consciousness of the contemporary English society, the formation of the idea of the democratic, legal state and civil society as well as legal mechanisms for their management in the practice of state establishment. The authors have substantially analysed the theoretical generalization of the political process in England by John Locke, stressed some of its aspects that have become the foundation of further development of the separation of powers theory, the fundamental principle of democratic state of legal character.Item Сутність терміну «закордонні дипломатичні установи України»: співвідношення назви та значення(Видавничий дім «Гельветика», 2021) Маркарян, Марина Валеріївна; Markarian, Maryna; Маркарян, Марина ВалерьевнаУ науковій статті розкривається зміст та сутність терміна «закордонні дипломатичні установи України», що використовується в сучасному вітчизняному законодавстві у сфері дипломатичних і консульських відносин.Здійснено короткий огляд еволюції терміна «закордонні дипломатичні установи України» на прикладі Закону України «Про дипломатичну службу» від 20.09.2001 р. (втратив чинність 19.12.2018 р.) та Закону України «Про дипломатичну службу» від 07.06.2018 р., який чинний нині. Проаналізовано, що до 2018 року термін «закордонні дипломатичні установи України» використовувалася лише для означення родового поняття, що відповідало категоріям «дипломатичні представництва України в інших державах», «консульські установи України в інших державах» та «представництва при міжнародних організаціях».На основі виокремлення основних ознак закордонних дипломатичних установ України автором пропонується викласти в новій редакції частину 4 статті 5 Закону України «Про дипломатичну службу» від 07.06.2018 р., що полягає у заміні визначення до терміна «закордонні дипломатичні установи України». Запропоновані зміни, передусім, викликані законодавчою новацією щодо передбачення нового виду закордонної дипломатичної установи – Посольства України з резиденцією Надзвичайного і Повноважного Посла України в Києві та порушенням мовних законів, що зустрічаються у наведеному визначенні.Крім того, з огляду на досягнення вітчизняної юридичної науки, враховуючи законодавчу базу та досвід зарубіжних країн підіймається питання про недоцільність використання терміна «закордонні дипломатичні установи України» та пропонується замінити його на термін «закордонні дипломатичні інституції України». Насамперед це викликано тим, що у теоретико-правовій науці та чинному законодавстві України категорії «установа» та «державний орган» не є тотожними поняттями, а відтак неприпустимо державний орган називати установою.З огляду на зазначене, автором робиться висновок про необхідність проведення подальшого реформування законодавства у сфері дипломатичних і консульських відносин, зокрема в контексті узгодження понятійно-категоріального апарату. The scientific article reveals the meaning and essence of the term "foreign diplomatic establishment of Ukraine", which is used in modern domestic legislation in the field of diplomatic and consular relations.A brief review of the evolution of the term "foreign diplomatic establishment of Ukraine" on the example of the Law of Ukraine "On Diplomatic Service" of 20.09.2001 (repealed on 19.12.2018) and the Law of Ukraine "On Diplomatic Service" of 07.06.2018 (valid today) was made. It was analysed that until 2018 the term "foreign diplomatic establishment of Ukraine" was used only to denote a generic concept that corresponded to the categories "diplomatic missions of Ukraine in other countries", "consulates of Ukraine in other countries" and "representation in international organizations".Based on the separation of the main features of foreign diplomatic missions of Ukraine, the author proposes to set out in the new version of Part 4 of Article 5 of the Law of Ukraine "On Diplomatic Service" of 07.06.2018, which is to replace the definition of "foreign diplomatic establishment of Ukraine". First of all, the proposed changes are related of a legislative innovation to provide for a new type of foreign diplomatic mission – the Embassy of Ukraine at the residence of the Extraordinary and Plenipotentiary Ambassador of Ukraine in Kyiv and violation of language rules. In addition, given the achievements of domestic legal science, the legislation base and experience of foreign countries raises the question of the unavailability of the use of the term "foreign diplomatic establishment of Ukraine" and proposes to replace it with the term "foreign diplomatic institutions of Ukraine". Визначено, що наразі ж поширеною є практика ведення дипломатичними представництвами сторінок у соціальних мережах, організації онлайн-лекцій та онлайн-брифінгів дипломатів, створення чат-ботів, інформаційних платформ, мобільних застосунків або ж різних дистанційних курсів, орієнтованих на популяризацію своєї країни в світі. У діяльності закордонних дипломатичних установ України не лише активно проваджуються різні форми та методи цифрової трансформації, а вже наявні й певні здобутки, що втілюються в реальних показниках. Передусім, цифрова трансформація у закордонних дипломатичних установах України спрямована на переведення більшості послуг в онлайн-формат, спрощення процедур їхнього отримання, мінімізацію бюрократичних формальностей, підвищення оперативності прийняття рішень та надання допомоги, оптимізацію фінансових витрат на утримання установ, доступність інформації та зменшення навантаження на працівників дипломатичних установ. Розкрито основні аспекти цифрової трансформації, яка нині відбувається у системі органів дипломатичної служби загалом, та у закордонних дипломатичних установах зокрема. Охарактеризовано основні здобутки МЗС України у напрямі цифрової трансформації, зокрема такі: впровадження проекту «ДРУГ» (Добровільна реєстрація українських громадян)» введення електронних черг в усіх закордонних дипломатичних установах України; надання доступу 2 мільйонам слабочуючим та нечуючим українцям до послуг МЗС завдяки новому програмному забезпеченню; зменшення терміну видачі українських е-віз для іноземців; створення чат-бот платформи для цілодобової консультативної підтримки громадян; упроваджено новий інформаційний ресурс «Поради подорожуючим від консульської служби України»; завершено формування нормативно-правової бази, необхідної для ведення консульського обліку в електронній формі (е-Облік); МЗС України під’єднано до системи електронної взаємодії «Трембіта», що прискорить отримання інформації від Міністерства внутрішніх справ України для оперативного підтвердження чинності посвідчення водія та видачі довідки про несудимість. Окреслено подальші напрями здійснення цифрової трансформації, що безпосередньо впливають на функціонування закордонних дипломатичних установ України, а саме: приєднання МЗС України до реєстрів інших органів, передусім Міністерства юстиції; запуск МЗС України модулів «е-Нотаріат», «е-Легалізація», «е-Апостиль» за сприяння Міністерства цифрової трансформації України та спільно з Міністерством юстиції України і Державною податковою службою України. The specifics of the functioning of foreign diplomatic institutions of Ukraine in the conditions of digital transformation have been studied. It was determined that the practice of maintaining pages in social networks, organizing online lectures and online briefings of diplomats, creating chatbots, information platforms, mobile applications, or various distance courses aimed at popularizing one's country in the world is currently widespread. In the activities of foreign diplomatic institutions of Ukraine, not only various forms and methods of digital transformation are actively pursued, but certain achievements are already available, which are embodied in real indicators. First of all, digital transformation in foreign diplomatic institutions of Ukraine is aimed at transferring most services to an online format, simplifying the procedures for obtaining them, minimizing bureaucratic formalities, increasing the efficiency of decision-making and providing assistance, optimizing financial costs for maintaining institutions, making information available and reducing the burden on employees diplomatic institutions. The main aspects of digital transformation, which is currently taking place in the system of diplomatic service bodies in general, and in foreign diplomatic institutions in particular, are revealed. The main achievements of the Ministry of Foreign Affairs of Ukraine in the direction of digital transformation were characterized, in particular the following: implementation of the project "DRUG" (Voluntary registration of Ukrainian citizens)" introduction of electronic queues in all foreign diplomatic institutions of Ukraine; provision of access to 2 million hard of hearing and deaf Ukrainians to the services of the Ministry of Foreign Affairs thanks to new software; reducing the deadline for issuing Ukrainian e-visas for foreigners; creation of a chatbot platform for round-the-clock advisory support of citizens; a new information resource "Advice to travelers from the consular service of Ukraine" was introduced; the formation of the regulatory and legal framework necessary for keeping consular records in electronic form (e-Accounting) has been completed; The Ministry of Foreign Affairs of Ukraine is connected to the "Trembit" electronic interaction system, which will speed up the receipt of information from the Ministry of Internal Affairs of Ukraine for prompt confirmation of the validity of a driver's license and the issuance of a criminal record certificate.
