Теоретико-правові засади механізму охорони населеннявід інфекційних хвороб

Abstract

В науковій статті досліджено концептуальні підходи до визначення таких понять, як «механізм», «організаційно-правовий механізм», «механізм адміністративного-правового регулювання», «механізм правового регулювання», «механізм державного регулювання», «механізм публічного адміністрування», «механізм охорони», проведено їх порівняльно-правовий аналіз, окреслено їх спільні та відмінні риси. Аргументовано, що термін «механізм» використовується у нерозривному поєднанні з іншими суміжними категоріями. На підставі здійсненого аналізу сформульовано поняття «механізм охорони населення від інфекційних хвороб», під яким пропонується розуміти сукупність адміністративних, організаційних, правових засобів, які застосовуються органами державної влади, а також органами місцевого самоврядування з метою забезпечення прав населення на охорону від інфекційних хвороб. Виокремлено складові елементи механізму охорони населення від інфекційних хвороб, якими є норми права, що визначають форми та методи впливу держави на поведінку суб’єктів правовідносин, сукупність їх прав та обов’язків, правова культура і правова свідомість. Окреслено взаємозв’язок та взаємодію елементів механізму охорони населення від інфекційних хвороб. Визначено мету та наслідки належного функціонування механізму охорони населення від інфекційних хвороб як комплексного поняття, реалізація елементів якого сприятиме фіксуванню в державі благополучної епідемічної ситуації. Обґрунтовано, що правові засади функціонування механізму охорони населення від інфекційних хвороб потребують свого подальшого вдосконалення, оскільки реалізація даного механізму має на меті формування благополучної епідемічної ситуації в державі та убезпечення населення від поширення інфекційних хвороб в цілому. На підставі наведеного узагальнення теоретичних та правових засад механізму охорони населення від інфекційних хвороб сформульовано пропозиції щодо законодавчого закріплення поняття механізму охорони населення від інфекційних хвороб шляхом внесення змін до Закону України «Про захист населення від інфекційних хвороб». The scientific article explored conceptual approaches to the definition of such concepts as “mechanism”, “organizational and legal mechanism”, “mechanism of administrative and legal regulation”, “mechanism of legal regulation”, “mechanism of state regulation”, “mechanism of public administration”, “mechanism of protection”, their comparative legal analysis was carried out, their general and distinctive features are outlined. It is argued that the term “mechanism” is used in an inextricable combination with other related categories. Based on the analysis, the concept of “a mechanism of protection of the population from infectious diseases” is formulated, which is proposed to mean a set of administrative, organizational, legal means that are used by state authorities, as well as local authorities in order to ensure the rights of the population to protect against infectious diseases. The constituent elements of the mechanism of protection of the population from infectious diseases, which are the norms of law that determine the forms and methods of State influence on the conduct of subjects of legal relations, the set of their rights and duties, legal culture and legal consciousness, are identified. The relationship and interaction of the elements of the mechanism of protection of the population from infectious diseases are outlined. The objectives and consequences of the proper functioning of the mechanism of protection of the population from infectious diseases are defined as a comprehensive concept, the implementation of the elements of which will contribute to the recording of a safe epidemic situation in the state. It is justified that the legal framework for the functioning of the mechanism of protection of the population from infectious diseases requires further improvement, since the implementation of this mechanism is aimed at creating a prosperous epidemic situation in the State and ensuring the safety of the population against the spread of infectious diseases in general. On the basis of this synthesis of the theoretical and legal foundations of the mechanism of protection of the population from infectious diseases, proposals have been formulated to legislate the concept of a mechanism for protecting the population from infectious diseases by amending the Law of Ukraine «On protection of the population from infectious diseases».
