| dc.description.abstract | У статті досліджуються питання правового регулювання, управління, контролю і нагляду у сфері надрокористування в період перебування українських земель у Литовсько-Польську добу (друга половина ХІV – початок ХVI ст.). Досліджено, що у зв’язку із занепадом Київської Русі та Галицько-Волинського князівства (середини ХІV ст.), західноукраїнські землі переходять під владу кількох держав: Польщі, Угорщини і Литви. Зазначено, що українські землі з другої половини ХІV ст. опиняються під владою Великого князівства Литовського. Досліджено, що Велике князівство Литовське являло собою могутню східноєвропейську державу з розвиненою економікою та правовою системою. Встановлено, що законодавчі акти Великого князівства Литовського базувались на українських традиціях «звичаєвого права» та нормах «Руської правди». Досліджено, що на формування правових норм Великого князівства Литовського вплинуло прийняття Литовських Статутів. Автором доведено, що норми Статутів не містили положення щодо права власності на надра, оскільки земля розглядалась як єдиний інтегрований природний об’єкт. Зазначено, що внаслідок укладання Люблінської Унії 1569 р., що об’єднала Польське королівство і Велике князівство Литовське, утворюється нова держава ‒ Річ Посполита, до складу якої приєднуються українські землі. Досліджено, що період перебування українських земель у складі Річі Посполитої позначився вдосконаленням законодавства кодифікацією, зокрема у сфері надрокористування. Автором встановлено, що нарівні з правовим регулюванням гірничих відносин у Річі Посполитій формувався інститут контрольно-наглядової діяльності. Відповідно до положень Гірничого статуту встановлювався перелік осіб, що здійснювали контроль і нагляд на гірничому підприємстві. Автором зроблено висновок, що період перебування українських земель у складі Литви та Польщі значно вплинув на розвиток правового регулювання гірничих відносин, а також формування інституту контрольно-наглядової діяльності. The article examines the issues of legal regulation, management, control and supervision in the field of subsoil use during the stay of Ukrainian lands in the Lithuanian-Polish era (the second half of the fourteenth ‒ early sixteenth century). It is studied that in connection with the decline of Kievan Rus and the Galicia-Volyn principality (mid-fourteenth century), the western Ukrainian lands came under the rule of several states: Poland, Hungary and Lithuania. It is noted that the Ukrainian lands from the second half of the fourteenth century came under the rule of the Grand Duchy of Lithuania. It is studied that the Grand Duchy of Lithuania was a powerful Eastern European state with a developed economy and legal system. It has been established that the legislative acts of the Grand Duchy of Lithuania were based on the Ukrainian traditions of “customary law” and the norms of “Russian Truth”. It has been studied that the formation of the legal norms of the Grand Duchy of Lithuania was influenced by the adoption of the Lithuanian Statutes. The author proved that the norms of the Statutes did not contain provisions on the right of ownership of subsoil, as the land was considered as the only integrated natural object. It is noted that as a result of the conclusion of the Union of Lublin in 1569, which united the Kingdom of Poland and the Grand Duchy of Lithuania, a new state was formed ‒ the Polish-Lithuanian Commonwealth, which included the Ukrainian lands. It is investigated that during the stay of Ukrainian lands in the Polish-Lithuanian Commonwealth, the codification legislation, including in the field of subsoil use, was affected by the improvement of the legislation. It was investigated that in accordance with the provisions of the Mining Charter, a list of persons who exercised control and supervision at the mining enterprise was established. It is noted that in accordance with the Mining Charter. The author concludes that the period of stay of the Ukrainian lands in Lithuania and Poland significantly influenced the development of legal regulation of mining relations, as well as the formation of the institution of control and supervision. | |
