Abstract
Стаття присвячена питанням удосконалення забезпечення конституційних прав людини в контексті євроінтеграційних процесів. У роботі подається загальна характеристика основних положень Конституції України, щодо визнання людини, її життя і здоров’я, честі та гідності, недоторканності і безпеки найвищою соціальною цінністю. Пояснюється, що саме права людини визначають зміст і спрямованість діяльності держави.
Систему конституційних прав і свобод людини і громадянина у статті представлено у вигляді наступних груп: особисті (громадянські), політичні, економічні, соціальні та культурні.
У досліджені названо, що, відповідно до Угоди про асоціацію між Україною, з однієї сторони, та Європейським Союзом, Європейським співтовариством з атомної енергії і їхніми державами-членами, з іншої сторони, у сфері прав людини особливого значення набувають питання щодо зміцнення та підвищення ефективності судової влади; захист персональних даних; співробітництва у сфері міграції; реалізації права та працю та забезпечення трудових прав працюючих; захисту прав на життя, свободу пересування; забезпечення інформаційних прав.
Відповідно до Загальнодержавної програми адаптації законодавства України до законодавства Європейського Союзу визначено, що пріоритетними сферами в контексті євроінтеграційних процесів забезпечення та розвитку прав людини є питання, що пов’язані з митним правом, законодавством про компанії, інтелектуальною власністю, охороною праці, захистом прав споживачів, та охороною здоров’я і життя людей. Аргументовано, що з урахуванням сучасної парадигми конституційного права, всі визначені сфери стосуються реалізації конституційних
прав людини і громадянина.
Окрема увага у роботі приділена питанню забезпечення та розвитку прав людини в Україні в контексті євроінтеграційних процесів в Україні. Проведено аналіз реалізації Національної стратегії у сфері прав людини протягом 2021–2022 рр. Визначено основні напрями удосконалення механізмів забезпечення належної прав у різних сферах суспільного життя, а також та удосконаленню конституційно-правового статусу людини у сучасних реаліях.
The article is devoted to issues of improving the provision of constitutional human rights in the context of European integration processes. The work provides a general description of the main provisions of the Constitution of Ukraine regarding the recognition of a person, his life and health, honor and dignity, inviolability and security as the highest social value. It is explained that it is human rights that determine the content and direction of the state's activities.
The system of constitutional rights and freedoms of a person and a citizen is presented in the article in the form of the following groups: personal (civil), political, economic, social and cultural.
The study stated that, by the Association Agreement between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community and their member states, on the other hand, in the field of human rights, issues of strengthening and increasing efficiency are of particular importance judiciary; protection of personal data; cooperation in the field of migration; implementation of the law and work and ensuring the labor rights of employees; protection of the rights to life, freedom of movement; provision of information rights.
Following the National Program for the Adaptation of the Legislation of Ukraine to the Legislation of the European Union, it is determined that the priority areas in the context of the European integration processes of ensuring and developing human rights are issues related to customs law, company legislation, intellectual property, labor protection, consumer rights protection, and protection of health and life of people. It is argued that, taking into account the modern paradigm of constitutional law, all defined areas relate to the realization of the constitutional rights of a person and a citizen.
Particular attention in the work is paid to the issue of ensuring and developing human rights in the context of European integration processes in Ukraine. An analysis of the implementation of the National Strategy in the field of human rights during 2021–2022 was carried out. The main directions for improving the mechanisms for ensuring proper rights in various spheres of social life, as well as improving the constitutional and legal status of a person in modern realities, were determined.
