| dc.description.abstract | Стаття присвячена теоретико-правовому дослідженню функцій муніципального права. У процесі дослідження було визначено поняття, правова природа, класифікація та основні ознаки функцій зазначеного права. This Article is devoted to theoretical and legal research of municipal law functions. The author of article formulates concept of function as a basis of construction of a branch attribute of development of the municipal law. The characteristic of the legal nature of concept function of the law shows attribute of formation of system of rules of municipal law and a direction of their development as a whole is given. In a basis of functions of the right there are functions of local self-management which are determined by the Constitution and Acts of Ukraine. Functions of the right define the basic directions and kinds of activity of local self-management in Ukraine. For example kratos function of the municipal law is capable to initiate of social subjects to normative behaviour and to guarantee the stable law and order. Function of communication of the municipal law characterizes of the directions and form of civilized dialogue between social subjects. Administrative functions are those related to the municipal management of the town and the execution of the laws that apply to the town. In the process of the execution of the local and district (regional) administration the municipalities shall be the subject of public law in compliance with the framework established by law, but with regard to the private law the municipalities shall have the rights of a legal person. Статья посвящена теоретико-правовому исследованию функций муниципального права. В процессе исследования были сформулированы понятие, правовая природа, классификация и основные признаки данного права. | uk_UA |
