Abstract
Cтаття присвячена оцінці сучасного стану комплаєнс-середовища ринку банківських послуг України. Запропоновано авторський погляд на комплаєнс з позиції комплаєнс-середовища банківської діяльності. Уточнено, що поняття «комплаєнс-середовище» не досліджувалося в економічній літературі. Проте коплаєнс-середовище тісно пов’язане з такими поняттями, як об’єкти комплаєнс-середовища, комплаєнс-поведінка та комплаєнс-ризик. Проведено аналітичний огляд економічної літератури в частині визначення сутності поняття комплаєнс. Запропоновано авторське визначення поняття комплаєнс-середовища діяльності банків. Здійснено аналіз заходів впливу НБУ за порушення законодавства у сфері фінансового моніторингу та валютного контролю в розрізі українських банків за період листопад 2019 – липень 2024 року. Шляхом використання методу «світлофора» у авторській інтерпретації оцінено сучасний стан комплаєнс-середовища українських банків. Визначено основні напрями розвитку банківського комплаєнс-середовища України.
The article is devoted to the assessment of the current state of the compliance environment of the banking services market of Ukraine. A review of the scientific literature on the essence and interpretation of compliance in a bank is carried out. The author's view on compliance from the perspective of the compliance environment of banking activities is proposed. It is specified that the concept of "compliance environment" has not been studied in the economic literature before. However, the compliance environment is closely related to such concepts as compliance objects, compliance behavior and compliance risk. The scope of application of compliance in corporate banking management is summarized. The author's definition of the compliance environment of banks is proposed. Compliance environment is a broader generalizing concept, a conditional space of banking activity for interaction between all existing banking and/or other regulatory (objective) requirements and participants in such an environment in which such participants strive to achieve potential and real compliance with such requirements. An analysis of the NBU's impact measures on banks' violations of legislation in the field of financial monitoring and currency control for the period November 2019 - July 2024 was conducted. Using the "traffic light" method in the author's interpretation, the current state of the compliance environment of Ukrainian banks was assessed. The results of the study proved the need to introduce effective compliance management into the practice of corporate banking management of all banks in Ukraine. Violation of the norms of the law leads to an increase in banking risks, so in order to minimize them, it is necessary to develop a banking compliance environment in which reputation, trust, and integrity should become key values for development. The main directions for the development of the banking compliance environment of Ukraine were identified. With the development of theoretical and methodological approaches to assessing the current state of the compliance environment of Ukrainian banks, the issue of compliance management will be further developed and will become a priority area for further scientific research.
