dc.description.abstractУ статті досліджено адміністративно-правові засади публічного адміністрування соціального забезпечення внутрішньо переміщених осіб в Україні як складової системи захисту прав людини в умовах воєнного стану та післявоєнного відновлення. Підкреслено, що феномен внутрішнього переміщення зумовлює появу нових соціальних ризиків і потребує адаптації існуючих механізмів публічного управління до надзвичайних умов. Розкрито сутність соціального забезпечення як конституційної гарантії та підкреслено його особливе значення для внутрішньо переміщених осіб, які втратили доступ до звичайних соціальних інституцій. Наголошено, що пенсійні виплати, допомоги та субсидії виступають не лише інструментом матеріальної підтримки, а й засобом інтеграції переселенців у приймаючі громади. Окрему увагу приділено інституційній структурі публічного адміністрування у сфері соціального забезпечення. Проаналізовано повноваження центральних органів виконавчої влади, Пенсійного фонду України, органів місцевого самоврядування та міжнародних організацій у реалізації соціальних прав внутрішньо переміщених осіб. Показано взаємозв’язок між централізованим регулюванням і локальними адміністративними практиками. Висвітлено проблеми чинного законодавства та адміністративної практики, пов’язані з процедурними складнощами, дублюванням функцій та відсутністю сталих цифрових рішень. Окреслено колізії між нормами національного права та міжнародними стандартами захисту прав переміщених осіб. Зроблено акцент на необхідності удосконалення правових механізмів і впровадження сучасних управлінських інструментів. Сформульовано висновок, що ефективне публічне адміністрування соціального забезпечення внутрішньо переміщених осіб має ґрунтуватися на принципах доступності, адресності, прозорості та адаптивності. Запропоновано напрями реформування правової та інституційної бази, спрямовані на забезпечення соціальної стабільності, інтеграції переселенців і зміцнення національної безпеки України. The article explores the administrative and legal foundations of public administration in the field of social security for internally displaced persons in Ukraine, conceptualized as an integral part of the system for protecting human rights under conditions of martial law and during the period of post-war recovery. It is emphasized that the phenomenon of internal displacement generates new social risks and necessitates the adaptation of existing mechanisms of public governance to extraordinary circumstances. The study reveals the essence of social security as a constitutional guarantee and highlights its particular significance for internally displaced persons who have lost access to ordinary social institutions. It is stressed that pension payments, financial aid, and subsidies serve not only as instruments of material support but also as mechanisms of integration of displaced persons into host communities. Special attention is devoted to the institutional structure of public administration in the field of social security. The article analyzes the competences of central executive authorities, the Pension Fund of Ukraine, local self-government bodies, and international organizations in the realization of the social rights of internally displaced persons. The interconnection between centralized regulation and local administrative practices is outlined. The article also addresses the shortcomings of the current legislation and administrative practice, including procedural difficulties, overlapping competences, and the absence of sustainable digital solutions. It identifies contradictions between the norms of national law and international standards on the protection of displaced persons. The necessity of improving legal mechanisms and implementing modern governance tools is emphasized. The conclusion states that effective public administration of social security for internally displaced persons must be based on the principles of accessibility, targeting, transparency, and adaptability. Directions for reforming the legal and institutional framework are proposed, aimed at ensuring social stability, fostering the integration of displaced persons, and strengthening the national security of Ukraine.
