Єдиний страховий ринок європейського співтовариства, як складова єдиного фінансового ринку спільноти: становлення та сьогодення

dc.description.abstractВ 50-х роках ХХ-го ст., а саме з прийняттям Римського договору 1957 року Європа започаткувала створення єдиного співтовариства, яке мало охоплювати різні сфери життя. Саме це стало передумовою формування єдиного фінансового ринку ЄС, який у свою чергу складається з трьох основних напрямків: банківському, страховому секторах та секторі капіталів та цінних паперів. При цьому, акцентовано увагу на тому, що страховий ринок стає все більш потужною рушійної силою розвитку економіки спільноти та забезпечення її стабільності. Формування та розвиток єдиного спільного страхового ринку спільноти мало свої етапи розвитку, які умовно можна поділити на 5 ключових етапи: 1) 1973-1979 рр. - директиви першого покоління; 2) 1988-1990 рр. - директиви другого покоління; 3) 1992-2000 рр. – директиви третього покоління; 4) 2000-2011 рр. - директиви четвертого покоління; 5) 2011 року - по теперішній час – новий етап у розвитку страхового ринку ЄС, пов'язаний зі створенням Європейського агентства зі страхування і професійних пенсій (EIOPA). Автором підкреслено, що кожен з цих етапів характеризується своєю специфікою. Першому етапу притаманний запровадження єдиного понятійного апарату, єдиної класифікації видів страхової діяльності, були встановлені єдині правила формування резервів страхових компаній тощо. Другий етап значно покращив регулювання страхової діяльності за рахунок конкретизації ризиків life та non-life страховиків, а також було визначено хто здійснює нагляд за страховими компаніями в залежності від ризиків. Для третього етапу було характерно запровадження «європейського паспорту» страховиків, визначені регуляторні органи, що здійснюють нагляд за страховою діяльністю, а також запроваджено взаємне визнання систем державного регулювання страхової діяльності. Четвертий етап характерний більш комплексним підходом щодо регулювання не тільки страхових, а й інших видів фінансових послуг в ЄС, що вилилося в прийняття нормативно-правих актів, які відомі як «Solvency». П’ятий і кінцевий етап характерний системними змінами в регулюванні комплексної фінансової системи ЄС, прийняттям «Solvency ІІ», створенням нової системи Європейських фінансових регуляторів тощо. In the 50s of the 20th century, namely with the adoption of the Rome Treaty in 1957, Europe initiated the creation of a single community that was supposed to cover various spheres of life. This became a prerequisite for the formation of a single financial market of the EU, which in turn consists of three main areas: banking, insurance and capital and securities sectors. At the same time, attention is focused on the fact that the insurance market is becoming an increasingly powerful driving force for the development of the community's economy and ensuring its stability. The formation and development of the common common insurance market of the community had its own stages of development, which can be conventionally divided into 5 key stages: 1) 1973-1979 - directives of the first generation; 2) 1988-1990 - directives of the second generation; 3) 1992-2000 – directives of the third generation; 4) 2000-2011 - directives of the fourth generation; 5) 2011 - to the present - a new stage in the development of the EU insurance market, associated with the creation of the European Insurance and Occupational Pensions Agency (EIOPA). The author emphasizes that each of these stages is characterized by its own specificity. The first stage is characterized by the introduction of a unified conceptual apparatus, a unified classification of types of insurance activity, unified rules for the formation of reserves of insurance companies, etc. were established. The second stage significantly improved the regulation of insurance activity by specifying the risks of life and non-life insurers, and it was also determined who supervises insurance companies depending on the risks. The third stage was characterized by the introduction of the "European passport" of insurers, the identification of regulatory bodies that supervise insurance activities, and the introduction of mutual recognition of systems of state regulation of insurance activities. The fourth stage is characterized by a more complex approach to the regulation of not only insurance, but also other types of financial services in the EU, which resulted in the adoption of regulatory acts known as "Solvency". The fifth and final stage is characterized by systemic changes in the regulation of the EU complex financial system, the adoption of Solvency II, the creation of a new system of European financial regulators, etc.
