Abstract
У статті досліджено вплив державного регулювання українського енергетичного ринку на розвиток підприємств-постачальників. Доведено, що попризначні зусилля у сфері лібералізації, імплементація деяких принципів Третього енергетичного пакету Європейського Союзу у національне законодавство призвела до викривлення конкуренції в сфері енергопостачання. Визначено основні загрози для розвитку постачальників, пов’язані зі змінами у регуляторному середовищі. Серед них: монополізація ринку, яка зводить нанівець стимули удосконалювати продажних сервісів у сфері постачання; непряма підтримка постачальників-монополістів державою, що посилює асиметричний характер конкуренції; відсутність чітко окреслених строків лібералізації ринку, їх постійне відтермінування у часі, що унеможливлює планування інвестицій; погіршення фінансового через зниження платіжної дисципліни споживачів, у тому числі внаслідок свідомого створення державою асиметричних умов для споживачів та постачальників.
The reform of the Ukrainian natural gas and electricity markets has opened opportunities for the development of new types of business in this area, in particular energy supply. There are more than 600 supplier companies that sell natural gas and electricity to end consumers. The development prospects of these market entities are largely determined by the peculiarities of their activities’ state regulation. The formally valid regulatory environment is based on the principles of the Third Energy Package of the European Union - free nature of pricing, prevention of discrimination of some market subjects by others, freedom of access to networks, free choice of supplier by the consumer, protection of the most vulnerable consumers. But despite all the efforts to liberalize, the sphere of supply in the energy markets of Ukraine remains uncompetitive. The reasons for this are: 1) the formal nature of unbundling (individual suppliers who have access to cheap energy resources of related structures receive unjustified price advantages); 2) non-market pricing in some market segments, in particular the household market, which prevents suppliers from investing in the development of sales services. The main threats to the development of suppliers associated with changes in the regulatory environment are: monopolization of the market, which nullifies incentives to improve business models in the field of energy supply; indirect support of monopolistic suppliers by the state, which distorts the competitive environment and makes it impossible to realize innovative advantages; the absence of clearly defined terms of market liberalization, their constant postponement over time, which makes it impossible to plan investments in development; deterioration of the financial condition due to a decrease in payment discipline, including due to the state's deliberate creation of asymmetric conditions for consumers and suppliers (suppliers must make payments in advance, but they cannot collect debts from consumers).
