Abstract
The article is devoted to the study of the specifics of the functioning of the probation institute in Germany and Austria.
The study is based on an analysis of special legislation, as well as German and Austrian specialized literature on the institute of probation. In addition, materials were analyzed that reflected the practical aspects of the probation institute in Germany and Austria.
The methodological basis of the study was comparative law and systematic research methods. Their application provided an opportunity to find out: the legal status of probation services in these EU member states, their internal structure, methods of interaction with former prisoners, to specify the areas of their activities.
As a result of the study, the following conclusions can be drawn: The probation institute in Germany and Austria aims at a common goal, which is the reintegration of persons who have served their sentences in prisons into society. It involves the return of former prisoners to a socially active, lawful lifestyle. This is one of the effective mechanisms to prevent the commission of new crimes by persons who have served a sentence for a previous crime. After all, it is obvious that it is not enough to punish a criminal, to limit him in social benefits and rights. Much more needs to be done. The point is that he must return to society as a full member.
In Germany and Austria, two fundamentally different models of probation have been introduced. In the first case, it is the state probation service, which reports to the Federal Ministry of Justice of Germany. The second case is a non-governmental organization that operates on the basis of state grants. Both models are effective and help achieve probation goals in these countries.
For Ukraine, from the experience of these countries, it is possible to borrow not only one or another model of probation service, but also the standards, directions and methods of their activities. It is a systematic approach to ex-prisoners, which is manifested in the search for new housing, new jobs, psychological support and, in general, adaptation to life in freedom. Without probation, such individuals are more likely to return to committing new crimes.
