Abstract
У статті досліджено політичну функцію держави як ключовий механізм реалізації суспільних інтересів у сучасному правовому полі. Автор аналізує зміст цієї функції, її взаємозв’язок з іншими функціями держави, а також значення у формуванні політичної стабільності, забезпеченні національної безпеки та досягненні суспільного консенсусу. Особливу увагу приділено трансформації політичної функції держави в умовах зовнішніх загроз, кризових явищ і викликів демократії. Обґрунтовано, що ефективне здійснення політичної функції держави сприяє зміцненню легітимності влади, активізації громадської участі та захисту основоположних прав людини. Визначено перспективи подальшого вдосконалення політичної функції в контексті побудови правової, демократичної та соціальної держави. Окремо розкрито специфіку та окремі наукові підходи до розуміння сутності політичної функції держави в умовах дії воєнного стану. Наголошено на тому, що в юридичній науці ця функція висвітлюється недостатньо системно, а найчастіше розглядається в контексті аналізу інших функцій держави. Автор підкреслює, що ключем до глибшого розуміння політичної функції сучасної української держави виступає характеристика державності – її суверенітет, який у період війни набуває особливого значення. Саме ця характеристика дозволяє чітко окреслити межі державної діяльності та диференціювати внутрішні й зовнішні функції. У таких обставинах функціонування української держави може бути спрямоване на забезпечення передбачуваності, ефективності та стабільного розвитку. У підсумку автор зазначає, що політична функція держави є однією з базових і визначальних у системі функцій держави, оскільки саме через її реалізацію відбувається формування, вираження та захист загальносуспільних інтересів, а також забезпечення політичної стабільності та легітимності влади. Ця функція виступає механізмом злагодження інтересів різних соціальних груп, інструментом впливу на політичну свідомість та участь громадян у державному управлінні, а також засобом реалізації державної політики, зокрема в умовах соціальних трансформацій чи загроз національній безпеці.
The article examines the political function of the State as a key mechanism for realization of public interests in the modern legal field. The author analyzes the content of this function, its interrelation with other functions of the State, as well as its importance in shaping political stability, ensuring national security and achieving social consensus. Particular attention is paid to the transformation of the political function of the state in the context of external threats, crises and challenges to democracy. It is substantiated that the effective exercise of the political function of the State contributes to strengthening the legitimacy of power, enhancing public participation and protecting fundamental human rights. The author identifies the prospects for further improvement of the political function in the context of building a legal, democratic and social state.The specifics and certain scientific approaches to understanding the essence of the political function of the State under martial law are separately disclosed. It is emphasized that in legal science this function is not covered systematically enough, and is most often considered in passing in the context of analysis of other functions of the State. The author emphasizes that the key to a deeper understanding of the political function of the modern Ukrainian state is the characteristic of statehood – its sovereignty, which is of particular importance in times of war. It is this characteristic that makes it possible to clearly define the boundaries of state activity and differentiate between internal and external functions. In such circumstances, the functioning of the Ukrainian state can be aimed at ensuring predictability, efficiency and stable development.In conclusion, the author notes that the political function of the State is one of the basic and defining functions of the State in the system of functions of the State, since it is through its implementation that the public interests are formed, expressed and protected, and political stability and legitimacy of the government are ensured. This function acts as a mechanism for reconciling the interests of different social groups, a tool for influencing political consciousness and participation of citizens in public administration, and a means of implementing the State policy, in particular, in the context of social transformations or threats to national security.
