dc.description.abstractУ статті розглянуто теоретичні засади та практичні аспекти системи комплаєнс-менеджменту в сучасних організаціях. Проведено огляд наукових публікацій міжнародного та національного рівня, а також аналіз досліджень провідних науковців і експертів у галузі комплаєнс-менеджменту. Обґрунтовано актуальність теми, зокрема, визначено роль комплаєнс-менеджменту як інструменту, що забезпечує відповідність діяльності організації внутрішнім політикам, чинному законодавству та етичним нормам. Показано, що ефективна система комплаєнс-менеджменту сприяє удосконаленню управлінських процесів, підвищує довіру до організації з боку стейкхолдерів, мінімізує ризики та запобігає правопорушенням. Основна частина статті зосереджена на розгляді таких аспектів: аналізуванні термінології та визначенні поняття «комплаєнс», визначенні особливостей впровадження функцій комплаєнс-менеджменту в організаціях, а також побудові системи комплаєнс-менеджменту. Детально досліджено, як поняття «комплаєнс» охоплює різні напрями, включаючи відповідність юридичним, етичним і соціальним вимогам. Зроблено висновок, що комплексний підхід до комплаєнсу є ключовим для ефективного управління в умовах глобалізації та посилення міжнародних стандартів. Також окреслено актуальність дослідження теоретичних основ системи комплаєнс-менеджменту організацій в сучасних умовах турбулентного середовища. Узагальнення різних підходів до визначення комплаєнс-менеджменту дозволило виділити основні сфери його застосування та адаптації до умов України та міжнародних практик. Наведено аргументи на користь впровадження системи комплаєнс-менеджменту в управління організацією як механізму контролю, що включає елементи аудиту відповідності та моніторингу ризиків. У висновках окреслено переваги впровадження комплаєнс-менеджменту, серед яких зростання конкурентоспроможності, забезпечення прозорості, підвищення ефективності діяльності організації, а також зниження ризиків. The article examines the theoretical principles and practical aspects of the compliance management system in modern organizations. A review of scientific publications of the international and national level was carried out, as well as an analysis of research by leading scientists and experts in the field of compliance management. The introduction substantiates the relevance of the topic, in particular, the role of compliance management as a tool that ensures compliance of the organization’s activities with internal policies, current legislation and ethical norms. It is shown that an effective compliance management system contributes to the improvement of management processes, increases trust in the organization on the part of stakeholders, minimizes risks and prevents offenses. The main part of the article focuses on the consideration of the following aspects: analysis of the terminology and definitions of the concept of «compliance», features of the implementation of compliance management functions in organizations, as well as the construction of a compliance management system. The concept of «compliance» covers various areas, including compliance with legal, ethical and social requirements. It was concluded that a comprehensive approach to compliance is the key to effective management in the conditions of globalization and strengthening of international standards. The relevance of the study of the theoretical foundations of the compliance management system of organizations in modern turbulent conditions is outlined. The generalization of various approaches to the definition of compliance management made it possible to highlight the main areas of its application and adaptation to the conditions of Ukraine and international practices. Arguments are presented in favor of the implementation of the compliance management system in the management of the organization as a control mechanism that includes elements of compliance audit and risk monitoring. The conclusions outline the advantages of implementing compliance management, including increasing competitiveness, ensuring transparency.
