| dc.description.abstract | Стаття присвячена аналізу Регламенту (ЄС) № 178/2002 як орієнтиру для визначення основної цілі та системи принципів публічного адміністрування у сфері забезпечення продовольчої безпеки України. У результаті проведеного дослідження з’ясовано те, що законодавство України у сфері забезпечення продовольчої безпеки вимагає ґрунтовного реформування. Основним орієнтиром у ньому має стати відповідний регламент ЄС, який закладає систему принципів забезпечення права на безпечне та достатнє харчування для кожного. The article is devoted to the analysis of Regulation (EC) No. 178/2002 as a guideline for determining the main goal and system of principles of public administration in the field of ensuring food security of Ukraine. The methodological basis of the research was: legal and systemic research methods. The research is based on the analysis of domestic, German and Austrian special literature, which is devoted to: general administrative law and special administrative law, public administration in the field of ensuring food security in Ukraine and the EU. In addition, the legislation of Ukraine and EU legislation, which is dedicated to public administration in this area, was analyzed. As a result of the conducted research, the following conclusions can be drawn: The analysis of the legislation of Ukraine makes it possible to ascertain the absence of qualitative legal regulation of public administration in the field of food security of Ukraine. First of all, it is about the absence of a specific law that would comprehensively regulate the relevant sphere of public relations. On the one hand, the project of the Food Security Strategy for the period of 2030 proposed by the Ministry of Agriculture has few prospects for its implementation, given the lack of real capacities in Ukraine to fulfill the tasks defined in it. On the other hand, this Project does not comply with the principles defined at the level of Regulation (EC) No. 178/2002, and therefore does not meet the standards of public administration in this field generally recognized at the EU level. The legal regulation of social relations in the sphere of food security of the Ukrainian state requires thorough reformation. We are convinced of the need to develop and adopt a special law on food security, which will become the legal basis of public administration in this area, define its goals and objectives, as well as the competence and powers of public administration subjects in this area of public administration. Taking into account the European integration aspirations of Ukraine, we are convinced of the necessity of mandatory consideration of the provisions of Regulation (EC) No. 178/2002 when reforming the normative regulation in the field of food security of Ukraine. This approach will enable Ukraine to become a component of the food safety system that functions at the level of the European Union. | |
