dc.description.abstractУ статті здійснено поглиблений науковий аналіз праць вітчизняних вчених на проблему потрапляння до засуджених в Україні заборонених предметів в умовах воєнного стану. Зазначено, що потрапляння до засуджених заборонених предметів в умовах воєнного стану варто розглядати, як різновид фонових явищ, які негативно впливають на детермінанти вчинення кримінальних правопорушень засудженими в установах виконання покарань ДКВС України. Доведено, що проблеми потрапляння заборонених предметів, до засуджених в установах виконання покарань ДКВС України як фонового явища засвідчують негативну тенденцію впливу на вчинення кримінального правопорушення потрапляння заборонених предметів, до засуджених. Це пов’язано з тим, що з одного боку, за статистикою Міністерства юстиції України кількісний склад засуджених зменшується, а з іншого боку, якісний склад осіб, які вчинили кримінальне правопорушення погіршується, як результат потрапляння заборонених предметів, до засуджених в установах виконання покарань ДКВС України збільшується. Обґрунтовано висновок про те, що потрапляння заборонених предметів, до засуджених в установах виконання покарань ДКВС України негативно впливає на оперативну обстановку в УВП, а рівень організації запобігання на всіх чотирьох рівнях (загальносоціальному, регіональному, спеціально-кримінологічному та індівідуально-профілактичному) не відповідає вимогам воєнного часу. Проведений поглиблений науковий аналіз праць вітчизняних вчених на проблему потрапляння до засуджених в Україні заборонених предметів в умовах воєнного стану, що дозволить виокремити проблемні питання та запропонувати шляхи їх вирішення. The article provides an in-depth scientific analysis of the works of domestic scholars addressing the problem of prohibited items entering the possession of convicted persons in Ukraine under conditions of martial law. It is noted that the entry of prohibited items to convicted persons during martial law should be considered as a type of background phenomenon that negatively affects the determinants of criminal offenses committed by convicted persons in penal institutions of the State Criminal-Executive Service of Ukraine. It is proven that the problem of prohibited items entering the possession of convicted persons in penal institutions of the State Criminal-Executive Service of Ukraine, as a background phenomenon, demonstrates a negative trend in influencing the commission of criminal offenses by convicted persons. This is due to the fact that, on the one hand, according to statistics of the Ministry of Justice of Ukraine, the quantitative number of convicted persons is decreasing, while on the other hand, the qualitative composition of persons who have committed criminal offenses is deteriorating. As a result, the number of cases involving the entry of prohibited items to convicted persons in penal institutions of the State Criminal-Executive Service of Ukraine is increasing. The conclusion is substantiated that the entry of prohibited items to convicted persons in penal institutions of the State Criminal-Executive Service of Ukraine negatively affects the operational situation in penal institutions, while the level of organization of prevention at all four levels (general social, regional, special criminological, and individual preventive) does not meet the requirements of wartime conditions. The conducted in-depth scientific analysis of the works of domestic scholars on the problem of prohibited items entering the possession of convicted persons in Ukraine under martial law makes it possible to identify problematic issues and propose ways to address them.
