    Поняття та елементи механізму адміністративно-правового регулювання випуску та реалізації нумізматичної продукції Національного банку України

    В статті визначено, що механізм адміністративно-правового регулювання випуску та реалізації нумізматичної продукції Національного банку України (НБУ) є важливою складовою державного управління у сфері грошового обігу. Він охоплює сукупність правових норм, адміністративних процедур і організаційних заходів, що визначають порядок випуску, обігу та продажу пам’ятних монет, сувенірної продукції та інших нумізматичних виробів. Основними елементами такого механізму є нормативно-правова база, компетентні органи, процедурні аспекти та контрольні заходи. Законодавче регулювання здійснюється на основі Конституції України, Законів України «Про Національний банк України», «Про платіжні системи та переказ коштів в Україні» та інших нормативних актів, що визначають повноваження НБУ щодо емісії нумізматичної продукції. Національний банк України виконує ключову роль у цьому процесі, розробляючи та затверджуючи дизайн, номінал, матеріали та інші характеристики монет. Процедура випуску включає розробку концепції, затвердження ескізів, виробництво монет на Монетному дворі та встановлення правил їх реалізації. Реалізація нумізматичної продукції здійснюється через офіційний інтернет-магазин НБУ, банківські установи та офіційних дистриб’юторів. Важливим аспектом є встановлення ціноутворення, що включає номінальну вартість, ринковий попит та інші економічні чинники. Контроль за дотриманням правил випуску та реалізації здійснюють НБУ, Державна фіскальна служба та інші компетентні органи, що забезпечують правомірність обігу та запобігання фальсифікації. Отже, адміністративно-правове регулювання випуску та реалізації нумізматичної продукції НБУ є складним і багатокомпонентним механізмом, що забезпечує стабільність грошового ринку, розвиток нумізматичної сфери та збереження національної історико-культурної спадщини. The article determines that the mechanism of administrative and legal regulation of the issue and sale of numismatic products of the National Bank of Ukraine (NBU) is an important component of state administration in the field of monetary circulation. It covers a set of legal norms, administrative procedures and organizational measures that determine the procedure for the issue, circulation and sale of commemorative coins, souvenir products and other numismatic products. The main elements of such a mechanism are the regulatory and legal framework, competent authorities, procedural aspects and control measures. Legislative regulation is carried out on the basis of the Constitution of Ukraine, the Laws of Ukraine “On the National Bank of Ukraine”, “On Payment Systems and Funds Transfer in Ukraine” and other regulatory acts that determine the powers of the NBU regarding the issue of numismatic products. The National Bank of Ukraine plays a key role in this process, developing and approving the design, denomination, materials and other characteristics of coins. The issuance procedure includes the development of a concept, approval of sketches, production of coins at the Mint and establishment of rules for their sale. The sale of numismatic products is carried out through the official online store of the NBU, banking institutions and official distributors. An important aspect is the establishment of pricing, which includes the nominal value, market demand and other economic factors. Control over compliance with the rules of issuance and sale is carried out by the NBU, the State Fiscal Service and other competent authorities that ensure the legality of circulation and the prevention of counterfeiting. Thus, the administrative and legal regulation of the issuance and sale of numismatic products of the NBU is a complex and multi-component mechanism that ensures the stability of the money market, the development of the numismatic sphere and the preservation of the national historical and cultural heritage.
