Abstract
Статтю присвячено аналізу економіко-правових засад, змісту й послідовності реалізації адміністративно-територіальної реформи та організації місцевої влади в Україні. Визначено ключові умови успішного втілення адміністративно-територіальних перетворень, а саме відповідну правову основу, раціональну систему організації органів місцевої влади, а також характер поділу функцій і повноважень між цими органами. Особливу увагу звернено до досвіду державотворення Польщі, як країни що успішно здійснила адміністративно-територіальну реформу в контексті децентралізації влади.
The article is devoted to questions of the administrative-territorial reform in Ukraine. The author pays attention to Poland’s successful experience in implementing the administrative territorial reform in Ukraine. The research is dedicated a comparative analysis of administrative and legal principles of activity of local governments in Ukraine and Poland. The key principles of successful implementation of administrative-territorial transformations are determined. Author has revealed the legislative framework of the system of organization of local authorities, as well as the nature of the division of functions and powers between these bodies. A lot of complicated aspects which are associated with the administrative territorial division in Ukraine, such as an unordered hierarchical structure of administrative units, fragmentation of administrative units at their basic level, etc. The legal framework in Ukraine is in need of improvement. On the basis of research, is offered suggestions for further development of administrative law, improvement of actual Ukrainian legislation, which regulates the activity of local governments. Local authorities, acting within the limits of the law, are to be able to manage a substantial share of public affairs under their own responsibility in the interests of the local population. Polish experience will help to hold a reform that will ensure that the interests of the state and of the local communities are in line with the interests of the state, and create a modern effective model of power that is capable to provide a higher standard of living for Ukrainian citizens.
