dc.description.abstractУ дисертації здійснено комплексний аналізадміністративно-правового регулюваннясфери фізичної культури і спорту як елемента національної безпеки України. Розкрито співвідношення понять «фізична культура» і «спорт», визначено їх функціональну єдність. Визначено систему принципів адміністративно-правового регулювання сфери фізичної культури і спорту як елемента національної безпеки України. Доведено, що в умовах особливого періоду державна політика у сфері фізичної культури і спорту має розглядатися як складова політики національної безпеки, оскільки безпосередньо впливає на обороноздатність держави шляхом фізичної та мобілізаційної готовності громадян, їх здатності до дій у кризових умовах. Розкрито зміст механізму адміністративно-правового регулювання сфери фізичної культури і спорту як елемента національної безпеки Українита його структуру. Вивчено зарубіжний досвід адміністративно-правового регулювання сфери фізичної культури і спорту як елемента національної безпеки. As a result of comparing the concepts of "physical culture" and "sport", it was established: physical culture as a broader concept encompasses a system of social relations, values, norms, practices and organizational forms aimed at ensuring the physical development of an individual, preserving the health of the population, forming resilience, social cohesion and readiness of citizens to effectively function in conditions of crisis situations and security threats; sport is a specialized segment of physical culture and is characterized by organization, competitiveness, institutional formality, regulatory order and the ability to perform not only competitive, but also socialization, educational, representative and security functions. It is determined that the principles of regulating the sphere of physical culture and sports as an element of national security of Ukraine are a systematically organized set of objectively determined, normatively fixed and functionally directed principles that determine the content, directions and limits of the administrative and legal influence of the state on the development of this sphere in order to ensure the physical fitness of the population, increase the level of its vitality, form mobilization readiness and strengthen the defense capability of the state. State policy in this sphere is a purposeful, normatively regulated, institutionally and organizationally supported activity of public administration bodies aimed at strengthening the physical, psychological and social potential of the population, developing sports infrastructure, supporting mass, inclusive and professional sports, ensuring the rehabilitation of military personnel and veterans, as well as integrating physical culture into the system of national resistance, patriotic education and restoration of human capital. Public administration in the field of physical culture and sports as an element of national security of Ukraine is defined as a hierarchically organized and functionally interconnected system of authorized entities, whose activities are aimed at the development of physical culture and sports, strengthening human potential, social stability, defense capability, rehabilitation capacity and protection of the national interests of Ukraine. It is argued that the tools of public administration in the field of physical culture and sports as an element of national security of Ukraine are a set of legal, organizational, informational, technical, financial and economic, control and coordination tools used by authorized entities of public administration to implement state policy in the relevant field, ensure public interest, maintain physical fitness of the population, develop sports infrastructure, organize physical culture and sports rehabilitation, strengthen human potential, social stability and national security of Ukraine. The following features have been identified: targeted focus on achieving public interest; implementation within the legal competence of public administration entities; legal certainty and regulatory consolidation; functional suitability for solving specific tasks; integrative nature: combination of legal, organizational, informational and technical means; flexibility and adaptability depending on the management level and conditions; focus on effectiveness and efficiency; controllability and accountability; systematicity and structure. Promising directions for improving the administrative and legal regulation of the sphere of physical culture and sports, taking into account its security, health, educational, rehabilitation and defense significance, have been identified.
