Abstract
В дисертації поглиблено теоретичні підходи і розроблені практичні рекомендації щодо вдосконалення регулювання цифрових фінансових активів в Україні. Визначене місце цифрових фінансових активів серед інших видів активів. Обґрунтовано можливість використання термінів цифрові активи, електронні активи, криптоактиви та віртуальні активи як синонімів. Встановлено, що у визначенні криптоактивів, яке надають міжнародні організації та регуляторні органи, характерним є акцентування уваги на їх походженні, із зазначенням того, хто може або не може бути їх емітентом. Узагальнено підходи до класифікації видів цифрових активів, які застосовуються регуляторами фінансового ринку в світі, та виділено основні критерії їх класифікації: за типом токена, за централізацією майданчиків (бірж) криптоактивів, за типом системи DLT, за типом зберігання криптографічних ключів, за місцем виконання процесів, за типом пропозиції/розміщення токенів.
The dissertation delves into theoretical approaches and proposes practical recommendations for enhancing the regulation of digital financial assets in Ukraine. It establishes the position of digital financial assets within the spectrum of various asset types and justifies the interchangeable use of terms such as digital assets, electronic assets, crypto assets, and virtual assets. It has been established that the definition of cryptoassets, as provided by international organizations and regulatory bodies, emphasizes their origin and specifies who can or cannot be their issuer. The document provides an overview of the classification approaches to digital assets employed by financial regulators worldwide, emphasizing the key criteria guiding their categorization: by the type of token, by the centralization of platforms (exchanges), by the type of DLT system, by the type of storage of cryptographic keys, by the place of execution of processes, and by the type of offer/placement of token.
