Item Використання матеріалів, одержаних у результаті оперативно-розшукової чи контррозвідувальної діяльності, проведення негласних слідчих (розшукових) дій у кримінальних провадженнях, відкритих за ознаками терористичних актів(Видавничий дім «Гельветика», 2026) Бондар, В. С.; Bondar, V.Актуальність статті полягає в тому, що для розв’язання багатьох слідчих ситуацій початкового етапу розслідування злочинів, передбачених ст. 258 Кримінального кодексу України (далі – КК України) необхідним є проведення заходів, передбачених Законами України «Про оперативно-розшукову діяльність», «Про контррозвідувальну діяльність», а також проведення негласних слідчих (розшукових) дій (далі – НСРД). З’ясовано, що правильне оформлення процесу та результатів оперативно-розшукової й контррозвідувальної діяльності дозволяє: 1) здійснювати оцінку отриманих відомостей та приймати необхідні рішення в процесі розробки та її завершення; 2) контролювати дії осіб, які беруть участь в розробці та весь хід діяльності в оперативно-розшуковій/ контррозвідувальній справі; 3) закріплювати та зберігати виявлені відомості про кримінально-протиправну-діяльність розроблюваних для правильного вирішення питання щодо відкриття кримінального провадження за ознаками терористичного акту та використання отриманих матеріалів в процесі досудового розслідування та судового розгляду. Систематизовані специфічні відомості даної категорії злочинів, пошук та виявлення яких дозволяють встановити зв’язок осіб, які безпосередньо вчиняють терористичний акт зі співробітниками спецслужб рф (фсб, гру, тощо). Обґрунтовано, що у провадженнях даної категорії проводяться такі НСДР: зняття інформації з електронних комунікаційних мереж; зняття інформації з електронних інформаційних систем; аудіо- відеоконтроль особи (з обладнанням засобів аудіо- відеоконтролю за місцем мешкання фігуранти та в транспортних засобах учасників оперативної розробки); установлення місцезнаходження радіоелектронного засобу (з метою ідентифікації та локалізації засобів зв’язку фігурантів, у тому числі й задіяних для комунікації із представниками спецслужб російської федерації); спостереження за особою (з використанням відеозапису, фотозйомки, спеціальних технічних засобів для спостереження), річчю або місцем; обстеження публічно недоступного місця, житла чи іншого володіння особи; накладення арешту на кореспонденцію); контроль за вчиненням злочину у формі спеціального слідчого експерименту. The relevance of the article lies in the fact that in order to resolve many investigative situations of the initial stage of the investigation of crimes stipulated by Art. 258 of the Criminal Code of Ukraine (hereinafter referred to as the Criminal Code of Ukraine), it is necessary to carry out measures stipulated by the Laws of covert investigative (investigative) actions (hereinafter referred to as the NSRD). It was found that the correct registration of the process and results of operational and investigative and counterintelligence activities allows: 1) to evaluate the information received and make the necessary decisions during the development and completion process; 2) to control the actions of persons participating in the development and the entire course of activities in the operational and investigative/counterintelligence case; 3) to fix and store the identified information about the criminal and illegal activities developed for the correct resolution of the issue of opening criminal proceedings on the grounds of a terrorist act and the use of the obtained materials in the process of pre-trial investigation and trial. Systematized specific information of this category of crimes, the search and detection of which allow establishing the connection of persons who directly commit a terrorist act with employees of the Russian Federation’s special services (FSB, GRU, etc.). It is substantiated that in proceedings of this category the following NSDR are carried out: removal of information from electronic communication networks; removal of information from electronic information systems; audio-video surveillance of a person (with the equipment of audio-video surveillance means at the place of residence of the person involved and in the vehicles of the participants in the operational development); establishment of the location of a radio-electronic device (in order to identify and localize the means of communication of the persons involved, including those used for communication with representatives of the Russian Federation’s special services); surveillance of a person (using video recording, photography, special technical means for surveillance), a thing or a place; inspection of a publicly inaccessible place, home or other property of a person; seizure of correspondence); control over the commission of a crime in the form of a special investigative experiment.
