Item Evolution of Constitutional Norms in Post-Soviet States: Democratic Procedure or Approval of Quo Status?(Atlantis Press, 2021-12) Bulbeniuk, Svitlana; Бульбенюк, Світлана Степанівна; Haponenko, Vira; Гапоненко, Віра Анатоліївна; Maneliuk, Yurii; Манелюк, Юрій МихайловичThe paper focuses on the political and value-ideological aspects of the evolution of constitutional norms in the post-Soviet space and in Ukraine, in particular, which determine such specific features of the constitutional process as approval of changes by trial and error, "compromise", mobilization of public support for constitutional changes. the aspirations of the elite to monopolize or change power, cyclical repetition of constitutional reforms’ content. A comparative analysis of changes to the constitution in Ukraine and other post-Soviet states according to the criteria of conservative constitutional process, reasons and drivers of changes to the Basic Law, the constitutional amendments’ content, features of constitutional control institutions, features of the change process, their political consequences, which allows identify general trends and specific regime and socio-cultural features, formulate recommendations for optimizing the constitutional process. The main arguments of the author's position of the research team on the expediency and objectivity of constitutional changes in Ukraine in the democratization of the political system, criteria for assessing their content, general recommendations for political aspects of stabilizing and optimizing the constitutionalism of post-Soviet states. У статті розглядаються політичні та ціннісно-ідеологічні аспекти еволюції конституційних норм на пострадянському просторі та в Україні, зокрема, які визначають такі особливості конституційного процесу, як затвердження, зміни методом проб і помилок, «компроміс», мобілізація громадської підтримки конституційних змін, прагненнями еліта монополізувати чи змінити владу, циклічне повторення змісту конституційних реформ. Порівняльний аналіз зміни до конституції в Україні та інших пострадянських державах представлений за критеріями консервативного конституційного процесу, причин та рушіїв внесення змін до Основного Закону, змісту конституційних змін, особливостей інститутів конституційного контролю, особливостей процесу змін, їх політичних наслідків, що дозволяє виявити загальні тенденції та специфічні режимні та соціокультурні особливості, сформулювати рекомендації щодо оптимізації конституційного процесу. These formal structures lack effectiveness and support, with informal, often non-democratic political processes and secret agreements continuing to prevail. The study aims to conclude a theoretical study, conceptualization, and generalization of the problems of the existence of informal institutions, as well as a comprehensive analysis of practical technologies of informal institutionalization in modern Ukraine. The authors used such general scientific methods as analysis and synthesis, induction and deduction, abstraction, the ascent from the abstract to the concrete. The authors considered such informal institutions that exist in the political reality of Ukraine, such as lobbying, corruption, populism, non-conventional forms of political participation of citizens, party agreements, clientelism, and political bargaining. The effective technologies for the informal institutionalization of modern Ukraine, including technologies for eliminating authoritarian practices, technologies of party structuring, technologies of political participation and technologies for the formation of democratic political consciousness have been proposed. This war is seen as a conflict of worldviews and values, a struggle of identities and historical memories. The methodological basis of the article is a combination of general scientific methods of comparative and historical analysis with special methods of narrative analysis. Based on the examples of the most common imperial narratives, it is substantiated that the latter have become an effective tool of justifying armed aggression against Ukraine and waging a genocidal war. It is emphasized that imperial narratives have always been tools of Russian propaganda aimed both at the direct and/or symbolic enemy, and at other people not directly involved in the existential struggle. Particular attention is paid to highlighting the manipulative influence and effects of Russian imperial narratives, the result of which is the affirmation of a positive image of Russia and the disappearance of Ukrainians and Ukraine as self-sufficient geopolitical entities from the mental map of most European nations. The ruling class of the Russian Federation, adopting the experience of digital totalitarianism in China, modifying the propaganda of the USSR and having sufficient financial capabilities, has been gradually moving in the direction of constructing its own model of digital autocracy over the past two decades. In the era of post-truth and complete digitalization, there has been a modification of Russian imperial narratives, which contributed to the spread of their influence. The author considers alternative (pro-) Ukrainian narratives as a tool of effective counteraction to Russian imperial narratives. Since we live in a networked society where information and communication technologies play a key role, it is important to examine how these factors shape the socio-political landscape. To achieve this goal, it is necessary to study the relationship between social and political structures, globalization processes and the development of information and communication technologies. We used the following methods: abstraction, deduction, systematization and generalization. It has been determined that the emergence of a network society causes a restructuring of socio-political institutions, which leads to the emergence of new structures and determines the specifics of the functioning of socio-political networks in the context of globalization. The influence of social institutions on digitalization is analyzed. The study of the representation of social interests at the network level was conducted in Ukraine in 2022. The transformation of the influence of information and communication networks on the development of socio-political structures of the network society and the formation of approaches to the interaction of the political apparatus with citizens is investigated. El objetivo del estudio es analizar la transformación de las estructuras sociopolíticas de la sociedad red, teniendo en cuenta la influencia de los procesos de globalización y el desarrollo de las tecnologías de la información y la comunicación. Dado que vivimos en una sociedad interconectada donde las tecnologías de la información y la comunicación desempeñan un papel clave, es importante examinar cómo estos factores configuran el panorama sociopolítico. Para lograr este objetivo, es necesario estudiar la relación entre las estructuras sociales y políticas, los procesos de globalización y el desarrollo de las tecnologías de la información y la comunicación. Se utilizaron los siguientes métodos: abstracción, deducción, sistematización y generalización. Se ha determinado que el surgimiento de una sociedad en red provoca una reestructuración de las instituciones sociopolíticas, lo que conduce al surgimiento de nuevas estructuras y determina las características específicas del funcionamiento de las redes sociopolíticas en el contexto de la globalización. Se analiza la influencia de las instituciones sociales en la digitalización. En 2022 se llevó a cabo en Ucrania un estudio sobre la representación de los intereses sociales a nivel de red. Se investiga la transformación de la influencia de las redes de información y comunicación en el desarrollo de las estructuras sociopolíticas de la sociedad red y la formación de enfoques para la interacción del aparato político con los ciudadanos. Метою дослідження є аналіз трансформації соціально-політичних структур мережевого суспільства з урахуванням впливу процесів глобалізації та розвитку інформаційно-комунікаційних технологій. Для досягнення цієї мети необхідно дослідити взаємозв'язок між соціальними та політичними структурами, процесами глобалізації та розвитком інформаційно-комунікаційних технологій. Були використані такі методи: абстракція, дедукція, систематизація та узагальнення. Було визначено, що виникнення мережевого суспільства спричиняє перебудову соціально-політичних інститутів, що призводить до появи нових структур та визначає специфічні особливості функціонування соціально-політичних мереж в умовах глобалізації. Проаналізовано вплив соціальних інститутів на цифровізацію. Дослідження представництва соціальних інтересів на мережевому рівні було проведено в Україні у 2022 році. Корецького Національної академії наук України, 2017) Бульбенюк, Світлана Степанівна; Bulbeniuk, Svitlana; Бульбенюк, Светлана СтепановнаWe consider the issues of interaction between government and civil society in modern Ukraine in terms of system calls through the prism kratological and management analysis and anthropological discourses. These discourses are concentrated in the kratological domain of research, because the issues of power in the domestic space forever are key in the theoretical and practical plane. Nowadays, the kratological discourse is complemented by the problem of studying the network of civil society and the E-state, which causes a qualitatively different view of political power - as a disperse phenomenon, a set of political alternatives known and equal to all rules. The author draws attention to the importance of lighting latent internal mechanisms for the implementation of political and / or power state for a deeper understanding of trends, implications and possible prospects of implementation of the strategy of systemic transformation of the Ukrainian state and society. At the same time, special attention is paid to the formation of a de facto semi-political confrontation between political and social actors of two types - representatives of the establishment and "opinion leaders" of the traditional and networked civil society. If the former are mainly representatives of the domestic political class of the post-Soviet period, then the latter are activists, intellectuals, artists, public, and eventually also potential statesmen (say, the young generation of people's deputies of the Verkhovna Rada of Ukraine of the VIII convocation), who came to the political and social advance during or after the revolutionary events of autumn 2013 - the winter of 2014. It is proved that in the conditions of those splits that occur now in Ukraine, the key social and political actors of socio-political shifts should be updated representatives of the ruling class, on the one hand, and «opinion leaders» from among the traditional and the network of civil society, on the other hand. Substantiates the view that the expression of an effective and truly democratic interaction of the state and civil society should be to ensure transparent competitive environment and creating a realm where it becomes possible political dialogue between the government and citizens, which the state is ready to negotiate with its citizens about the important issues of social development. After all, the main problems of the national state building in Ukraine in the last two and a half decades are related precisely to the fact that the domestic ruling class has not managed to conduct a permanent public dialogue with citizens, and those attempts to formulate and put forward relevant projects of social agreements that were carried out by social actors from the civil society, did not find an adequate response from the political actors on the part of the state. Thus, it can be argued that while the attempts to "conventionalisation" Ukrainian political life are a model of "one-gates", when only one side of a potential public-public dialogue and the conclusion of a social contract on its basis is interested in such a process. Moreover, the representatives of the establishment of various ideological and ideological and geopolitical directions, from the conventionally "pro- Moscow" to the conditionally "pro-American" and "pro-European" ones, have shown their disinterest. The basis of such a political dialogue should be symbolic of the conclusion convene social contract between senior representatives of the state and civil society on the basis of a political and social compromise. The importance of achieving a political and social compromise is due not only to the fact that without its achievement it is impossible to speak about the further political and socio-economic progress of our state in the conditions of a long Russian-Ukrainian military conflict and the unsolved numerous splits (intergenerational, value, structural-institutional, geopolitical And others) within the domestic society, but also because in recent decades, under the influence of the deployment and deepening of the processes of informatization and globalization in a substantial way the understanding of political and / or state power has changed - its essence, purpose, features of interaction with society and citizens. Обгрунтовано, що одним з центральних завдань російської агресії є геноцид українців як політичної нації. Розглянуто дві форми геноциду у російсько-українській війні – урбоцид та сексуальне насильство. Урбоцид як свідома і цілеспрямована стратегія знищення міст і міської інфраструктури в російсько-українській війні у 2022 р. став однією з найбільш поширених форм геноциду українського народу. Тотальне руйнування Маріуполя навесні 2022 р. є символом урбоциду в Україні, вчиненого рф. Міста, особливо мегаполіси та регіональні центри, яким був Маріуполь у 2014–2021 рр., мають особливе політичне значення, стаючи осердями політичної і соціальної активності громадян, місцями утворення і розвитку креативного класу та інтелектуальними осередками нації. Маріуполь після окупації Донецька у 2014 р. став інтелектуальним і модерновим центром українського Донбасу, тому його тотальне руйнування як вияв урбоциду має символічне значення. Сексуальне насильство незмінно супроводжує усі війни, його слушно розглядати не тільки як один з чинників війни, але й як форму здійснення стратегії геноциду. Метою сексуального насильства є знищення демографічного потенціалу народу/нації – об’єкту агресії, тому воно тлумачиться як одна з форм геноциду. Найтиповішим проявом сексуального насильства у російсько-українській війні у 2022 р. стали зґвалтування – не просто акт індивідуального насильства, а акт залякування і насильства з довготривалими негативними наслідками. Геноцид українського народу супроводжує дискурс заперечення, який поширюється і з боку офіційних представників рф, і з боку представників ліберальної російської опозиції, які перебувають в екзилі. Найтиповішими проявами такого дискурсу є наративи «сancel culture» та «російський народ теж є жертвою геноциду», а також штучно створений образ «хороших рускіх» на противагу «поганим». The genocide is considered in the context of the course of the Russian-Ukrainian war in 2022. It is justified that one of the central tasks of Russian aggression is the genocide of Ukrainians as a political nation. Two forms of genocide in the Russian-Ukrainian war are considered – urbocide and sexual violence. Urbocide as a deliberate and purposeful strategy for the destruction of cities and urban infrastructure in the Russian-Ukrainian war in 2022 became one of the most widespread forms of genocide of the Ukrainian people. The total destruction of Mariupol in the spring of 2022 is a symbol of the urbocide in Ukraine committed by the Russian Federation. Cities, especially megacities and regional centers, such as Mariupol in 2014–2021, have a special political significance, becoming centers of political and social activity of citizens, places of formation and development of the creative class, and intellectual centers of the nation. After the occupation of Donetsk in 2014, Mariupol became the intellectual and modern center of the Ukrainian Donbas, therefore its total destruction as a manifestation of urbocide has a symbolic meaning. Sexual violence invariably accompanies all wars, it should be considered not only as one of the factors of war, but also as a form of implementation of the strategy of genocide. The purpose of sexual violence is to destroy the demographic potential of the people/nation – the object of aggression, therefore it is interpreted as a form of genocide. The most typical manifestation of sexual violence in the Russian-Ukrainian war in 2022 was rape – not just an act of individual violence, but an act of intimidation and violence with long-term negative consequences. The genocide of the Ukrainian people is accompanied by a discourse of denial, which is spread both by official representatives of the Russian Federation and by representatives of the liberal Russian opposition in exile. The most typical manifestations of such a discourse are the narratives "сancel culture" and "the Russian people are also victims of genocide", as well as the artificially created image of "good Russians" as opposed to "bad".Item Громадянське суспільство в Україні: дуалізм відповідальності і свободи(Національний педагогічний університет імені М. Запропоновано обґрунтування авторського погляду на політико-правову природу політичної відповідальності та аксіологічно-світоглядну природу політичної свободи, спираючись на з’ясування динаміки розвитку громадянського суспільства. Досліджується зміст феномену політичної адаптації як синкретизму політичної свободи і політичної відповідальності. Окрема увага звертається на розгляд базових передумов становлення громадянського суспільства в Україні у контексті аналізу взаємозв’язку і взаємозалежності політичної відповідальності та політичної свободи. The article highlights the problems of duality responsibility and freedom as a normative value bases of formation and development of civil society in Ukraine. Provides the rationale for the author's view of political and legal nature of political responsibility and axiological-ideological nature of political freedom, based on a study of the development of civil society. The author analyses the phenomenon of political adaptation as a syncretism of political freedom and political responsibility. Special attention is drawn to the consideration of the basic preconditions of formation of civil society in Ukraine in the context of the analysis of the relationship and interdependence of political responsibility and political freedom. В статье освещается проблематика дуализма ответственности и свободы как нормативно-ценностных основ становления и развития гражданского общества в Украине. Предложено обоснование авторского взгляда на политико-правовую природу политической ответственности и аксиологическо-мировоззренческую природу политической свободы, опираясь на выяснение динамики развития гражданского общества. Исследуется содержание феномена политической адаптации как синкретизма политической свободы и политической ответственности. Лобізм розглядається як специфічна форма впливу на органи державної влади та інститути громадянського суспільства з метою захисту інтересів певних соціальних груп, об’єднань або окремих осіб, а найголовніше – як один з механізмів сучасної демократії, що поєднує обидві її форми – пряму та представницьку. Обґрунтовується важлива роль лобізму у прикладному полі публічної політики. Авторами проаналізовано політико-правову еволюцію лобізму, зокрема еволюцію легалізації лобізму на нормативному рівні на прикладі США, країн Європейського Союзу, України. Особливу увагу приділено питанням висвітлення лобізму як інструменту політичної діяльності та політичної комунікації, а також викликам правового регулювання лобістської діяльності у демократичних державах. Підкреслено як позитивні аспекти лобізму (забезпечення комунікації між владою і суспільством, підтримка балансу інтересів), так і негативні наслідки за відсутності належного контролю (корупція, маніпуляції, тіньовий вплив). У статті також розглянуто особливості функціонування лобізму з точки зору безпекових викликів розвитку сучасних держави і громадянського суспільства. Лобізм у царині публічної політики висвітлено крізь призму вимірів суспільного інтересу та політико-владного інструментарію забезпечення реалізації вимог суспільного інтересу, що обумовлює застосування міждисциплінарного підходу до розгляду феноменів лобізму і лобіювання. Додатково використано метод аналізу документів, зокрема Конституції України та Закону України «Про лобіювання» (у контексті висвітлення «сильних» та «слабких» сторін цього нормативного акту), а також метод порівняльного аналізу щодо висвітлення законодавчого регулювання феномену лобізму в США, країнах ЄС та Україні. Автори дійшли висновку, що подальша дослідницька увага в аналізі лобізму як інструменту політичної діяльності і політичної комунікації має бути зосереджена на вивченні безпекових аспектів цього феномену публічної політики. The article analyses lobbying as a complex socio-political phenomenon that plays an important role in the process of shaping public policy and making political and administrative decisions. Lobbying is seen as a specific way to influence government bodies and civil society institutions to protect the interests of certain social groups, associations, or individuals, and most importantly, as one of the mechanisms of modern democracy that combines both of its forms – direct and representative. The important role of lobbying in the applied field of public policy is substantiated. The authors analyse the political and legal evolution of lobbying, in particular the evolution of the legalisation of lobbying at the regulatory level, using the examples of the United States, European Union countries and Ukraine. Particular attention is paid to the issues of lobbying as a tool of political activity and political communication, as well as the challenges of legal regulation of lobbying in democratic states. Both the positive aspects of lobbying (ensuring communication between the authorities and society, maintaining a balance of interests) and the negative consequences of a lack of proper control (corruption, manipulation, shadow influence) are highlighted. The article also examines the peculiarities of lobbying from the point of view of security challenges to the development of modern states and civil society. Lobbying in the field of public policy is examined through the prism of public interest and the political and governmental instruments for ensuring the implementation of public interest requirements, which necessitates an interdisciplinary approach to the study of the phenomena of lobbying and lobbying. In addition, the method of document analysis was used, in particular the Constitution of Ukraine and the Law of Ukraine “On Lobbying” (in the context of highlighting the “strong” and ‘weak’ sides of this normative act), as well as the method of comparative analysis to highlight the legislative regulation of the phenomenon of lobbying in the United States, EU countries and Ukraine.
