Thus, the application of artificial intelligence technologies requires new approaches to citation, substantiation of research methodology, development of standards for acceptable means of its application. Also, academic integrity crucially changes its means in societies at risk. From the beginning of the hybrid war in 2014 and full-scale invasion in 2022 Ukrainian society constantly suffers from the violation of basic human rights, the goals of sustainable development of the United Nations. Nowadays we should find the answers: how higher education can help to achieve the goal of building a peaceful and safe, socially cohesive society with good governance and inclusive institutions by encouraging integrity.Item Access to reproductive rights through cross border reproductive care(Pan-European University, 2020) Hryhorenko, Olena; Григоренко, Олена В’ячеславівнаThe existence of the humanity is possible till the moment reproduction exists. The level of citizens’ health of any country shows us the level of the economic, demographic, cultural and political development of the country. However, despite the importance of the social relations, national laws are not provided with full range of opportunities about the reproductive health. A special place here is dedicated to the national level of legislation of the relationships with the use of artificial reproductive technologies. Law is designed to take into account some aspects of the existing problems of different nature and at the legislative level to summarize all the views available in the country by permission or prohibition due to a variety of assisted reproductive technologies. Infertility is known as a disease of the XXI century. Bad ecology, hereditary factors, stress, lack of sports, unhealthy lifestyle – all this is incidental causes of infertility. The percentage of infertility in Ukraine is extremely impressive – its level reaches 15–25% of the population of reproductive age. Every fifth family in Ukraine cannot deliver a child in a natural way. And, unfortunately, this problem is not unique to Ukraine. People around the world suffer from this problem. The purpose of the article is to conduct a scientific study on the legal bases for the existence and development of Internet commerce in Ukraine and to outline the administrative and legal mechaniss of consumer protection in the Internet space. The leading research methods are general scientific and specific research methods, including methods of logic, analysis, comparison. The results of this study are to identify innovative ways to protect the rights of domestic consumers and ways to improve Ukrainian legislation during trading operations in cyberspace. It has been established that an extremely important role in exercising rights and guarantees of forced migrants belongs to such a public initiative as “Prykhystok” (“Shelter”).Item Analysis of the Fundamentals of Ukraine's Information Security Policy: Modern Imperatives of Sustainable State Development(Universidad del Zulia, 2024) Nazarchuk, Oleksandr; Nikolaieva, Tetiana; Ніколаєва, Тетяна Михайлівна; Zaporozhets, Oksana; Bielousova, Nataliia; Andrieieva, OlhaThe aim of the article is to research the foundations of Ukraine's information security policy based on a study of the relevant modern imperatives of sustainable development of the state and existing international practices. To achieve this goal, theoretical methods of scientific research are used. Results: the authors examine the existing practices of information security in the leading European countries that determine the current European policy, including in relation to Ukraine in times of war (the Republic of Poland, the Federal Republic of Germany, the French Republic). The main focus is on the introduction of a clear regulatory framework and the establishment of cooperation with civil society institutions. In order to form a high-quality system of Ukrainian information security, it is also proposed to introduce a reasonable balance between the existing constitutional rights and freedoms of citizens when using information resources, support the relevant legislative framework, emphasize the Ukrainian-centered cultural and information product, and develop mechanisms for effective interaction with civil organizations and institutions. The conclusions also highlight the need to improve information and digital culture among Ukrainians, which will be the key to overcoming some of the challenges associated with the spread of propaganda or cybercrime. El objetivo del artículo es analizar los fundamentos de la política de seguridad de la información de Ucrania a partir del estudio de los imperativos modernos pertinentes del desarrollo sostenible del Estado y de las prácticas internacionales existentes. Para lograr su objetivo se utilizan métodos teóricos de investigación científica. Autores también examinan las prácticas existentes en materia de seguridad de la información en los principales países europeos que determinan la política europea actual, incluso en relación con Ucrania en tiempos de guerra (la República de Polonia, la República Federal de Alemania y la República Francesa). Para formar un sistema de seguridad de la información ucraniano de alta calidad, también se propone introducir un equilibrio razonable entre los derechos constitucionales existentes y las libertades de los ciudadanos a la hora de utilizar los recursos de información, apoyar el marco legislativo pertinente, hacer hincapié en el producto cultural e informativo centrado en Ucrania y desarrollar mecanismos para una interacción eficaz con las organizaciones e instituciones públicas. Las conclusiones también destacan la necesidad de mejorar la cultura informativa y digital entre los ucranianos, lo que será clave para superar algunos de los retos asociados a la difusión de propaganda, la ciberdelincuencia. Метою цієї статті є аналіз основ політики інформаційної безпеки України шляхом вивчення відповідних сучасних імперативів сталого розвитку держави та існуючої міжнародної практики. Для досягнення цієї мети використовуються теоретичні методи наукового дослідження. Автори також розглядають існуючі практики інформаційної безпеки в ключових європейських країнах, які визначають сучасну європейську політику, зокрема ті, що стосуються України воєнного часу (Республіка Польща, Федеративна Республіка Німеччина та Французька Республіка). Для розробки якісної української системи інформаційної безпеки також пропонується запровадити розумний баланс між існуючими конституційними правами та свободами громадян під час використання інформаційних ресурсів, підтримати відповідну законодавчу базу, зробити акцент на культурних та інформаційних продуктах, орієнтованих на Україну, та розробити механізми ефективної взаємодії з громадськими організаціями та установами. У висновках також наголошується на необхідності покращення інформаційної та цифрової культури серед українців, що буде ключовим для подолання деяких викликів, пов'язаних з поширенням пропаганди та кіберзлочинності.Item Analysis of the issues of justice accessibility, equality, and countering discrimination in the legal system(Universidade Católica de Petrópolis, 2023) Potapchuk, Hanna; Boiarsky, Oleksandr; Donchenko, Olha; Nazarchuk, Oksana; Назарчук, Оксана Михайлівна; Назарчук, Оксана Михайловна; Kubariev, IvanAccessibility of justice and equality is the realization of one of the fundamental rights of a person and a citizen - the right to protect their legitimate rights and interests with the help of the most democratic and effective tool for such protection, which is justice. This fact is reflected in both international legal acts and Ukrainian legislation. However, the issue of justice accessibility for all categories and groups of the population still remains quite acute. This is quite understandable due to the complexity of the judicial system, the insufficient legal culture of the population, and, in addition, insufficient legislative support for the implementation of this constitutional right. These circumstances emphasize the relevance of scientific research in identifying and overcoming issues of justice accessibility. The main research object in this article is the social relations that arise in ensuring the constitutional principle of accessibility of justice for all individuals, legal entities, and public entities. The research subject is the legislative provisions in this area, as well as the views of contemporary Ukrainian scholars on the concept and essence of the principle of justice accessibility. The scientific novelty of this study lies in establishing the multidimensionality of this principle and its conditionality both by removing obstacles to access to justice for all categories of persons and by establishing a system of state guarantees ensuring access to justice. Also, this criterion makes it possible to assess the actual efficiency of the judicial system itself based on this criterion. The relevance of the research is determined by the fact that the judicial system plays an essential role in a democratic society. Since one of the main principles of our state is the rule of law, the judiciary should adequately fulfill its function. The judiciary is independent, and the principles enshrined in the Constitution of Ukraine guarantee such independence. These democratic principles, on which the judicial system is built, determine the peculiarities of the legal system. The democratic nature of the justice principles lies in the fact that they ensure that justice is administered on an equal basis, only by a court, collegially, by independent judges, openly, using the state language, with the process recorded, and in full compliance with the law. A acessibilidade da justiça e da igualdade é a concretização de um dos direitos fundamentais de uma pessoa e de um cidadão -o direito de proteger os seus direitos e interesses legítimos com a ajuda do instrumento mais democrático e eficaz para essa protecção, que é a justiça. Este facto reflecte-se tanto nos actos jurídicos internacionais como na legislação ucraniana. Contudo, a questão da acessibilidade da justiça para todas as categorias e grupos da população continua a ser bastante aguda. Isto é perfeitamente compreensível devido à complexidade do sistema judicial, à insuficiente cultura jurídica da população e, além disso, ao insuficiente apoio legislativo para a implementação deste direito constitucional. Estas circunstâncias enfatizam a relevância da investigação científica na identificação e superação de questões de acessibilidade à justiça. O principal objeto de pesquisa deste artigo são as relações sociais que surgem na garantia do princípio constitucional da acessibilidade da justiça a todas as pessoas físicas, jurídicas e entes públicos. O tema da investigação são asdisposições legislativas nesta área, bem como as opiniões dos estudiosos ucranianos contemporâneos sobre o conceito e a essência do princípio da acessibilidade da justiça. A novidade científica deste estudo reside em estabelecer a multidimensionalidade deste princípio e a sua condicionalidade, tanto através da remoção de obstáculos ao acesso à justiça para todas as categorias de pessoas, como através do estabelecimento de um sistema de garantias estatais que garantem o acesso à justiça. Além disso, este critério permite avaliar a real eficiência do próprio sistema judicial com base neste critério. A relevância da investigação é determinada pelo facto de o sistema judicial desempenhar um papel essencial numa sociedade democrática. Dado que um dos princípios fundamentais do nosso Estado é o Estado de Direito, o Judiciário deve cumprir adequadamente a sua função. O poder judicial é independente e os princípios consagrados na Constituição da Ucrânia garantem essa independência. Esses princípios democráticos, sobre os quais se baseia o sistema judicial, determinam as peculiaridades do sistema jurídico. A natureza democrática dos princípios de justiça reside no facto de garantirem que a justiça é administrada em igualdade de condições, apenas por um tribunal, colegialmente, por juízes independentes, de forma aberta, utilizando a linguagem do Estado, com o processo registado e em total conformidadecom a lei.Item Best International Practices of Combating Terrorism and Organised Crime by Special Units and Law Enforcement Agencies(Shiny World Corporation, 2021) Pavlovska, Nataliia; Павловська, Наталія Володимирівна; Kulyk, Maryna; Tereshchenko, Yuliia; Strilets, Halyna; Symchuk, AnatoliiTherefore, this unit as a component of the gendarmerie is built on the principle of a military unit. The gendarmerie, one of the few state institutions in France, has been in existence for over 200 years and has a status as a significant component of the country's armed forces and is an extremely important part of the police system. The gendarmerie is subordinated to the Ministry of Defense (on the authority of the Main Directorate), and on the ground - to the command of military districts. At the same time, the gendarmerie is at the operational disposal of the Ministry of Internal Affairs and the Ministry of Justice. Significant autonomy within the Armed Forces allows the gendarmerie to combine military functions with purely police and administrative ones. The difference between police and gendarmerie is that the police are civilian civil servants. They can wear civilian clothes and trade union and political freedoms. Gendarmes also have the status of servicemen and military ranks, always in uniform, not entitled to strike and are responsible for violations in accordance with military charters - from guardians to dismissal from service (for example, for the use of alcohol "in the performance of official duties" the gendarme is threatened arrest for up to 30 days). The need for the creation of the Austrian Special Forces was conditioned by the urgency of taking measures to ensure the safety of the flow of emigrants of Jewish nationality from the former USSR since in autumn 1973 against them was committed serious terrorist act. Special unit "Cobra" enters the warehouse of the Ministry of Internal Affairs and has got a double subordination: through direct combat engagement to the head of public safety, and in relation to personnel issues and logistics - the central command of the gendarmerie of the Austrian Ministry of Internal Affairs. Among the well-known British Special Political Service (Special Air Service, or SAS) is probably the best counterterrorism unit. Its component - Special Projects (SP) team - the main anti-terrorist squad. The Special Air Service and its Counter Revolutionary Warfare Squadron (CRW) unit, the Antirevolutionary Military Squadron, were founded in 1942. The feature of training SAS servicemen is to teach each soldier to possess all methods and means of combating terrorism. To achieve this, SAS trains all of its squadron through training cycles. Acquired skills are improved later in the SP-team's combat duties. The main thing in the work is the maximum approximation of training sessions to a real combat situation in the conduct of operations on the release of hostages, in the role of which are civilians. Anti-terrorist training of SAS and the development of practical measures for the release of hostages is facilitated by the fact that high-ranking members of the British Government, including the Prime Minister, are personally involved in it.Item Cargocultism of psychiatric care in custody(Wydawnictwo ALUNA, 2021-11) Yanovska, Oleksandra; Chuhaievska, Alona; Чугаєвська, Альона Вікторівна; Чугаевская, Алёна Викторовна; Ivanov, MykhailoThe aim: To analyze the features of the realization mechanism of the persons’ rights who have become ill with a mental illness and are in the detention of adequate (equivalent) medical care. Materials and methods: A set of general and special methods of scientific knowledge were used. The study’s empirical basis consists of international acts and standards in the field of health care, statistics of the United Kingdom, France, the United States, some countries in Eastern Europe and Central Asia, reports of international organizations, the case-law of the European Court of Human Rights. The study also used the personal experience of one of the co-authors as a lawyer for more than 20 years and 4 years as a judge of the Supreme Court. Results: The conducted research gives grounds to state that for the last few decades the problem of receiving psychiatric care in conditions of imprisonment remains relevant. This situation is partly due to the fact that the certain standards’ content is subject to clarification, as it is contained in optional international instruments or is given some understanding solely through the practice of the ECHR. Given the implementation of the prisoners’ right of access to psychiatric care is entrusted primarily to penitentiary institution’s administration, attention should be paid to methodological, material, and staffing of their work while introducing maximum openness of psychiatric care’s algorithms to prisoners and facilitating access to legal aid for the mentally ill. Conclusions: Creating external attributes of mechanisms to ensure the convicts’ right to psychiatric care, the relevant national mechanisms do not take into account the specifics of the detained persons’ legal status. Such a superficial imitation of the system of guarantees of the prisoners’ rights to medical care is a kind of cargo cultism of public institutions, which is designed to provide non-discriminatory conditions for the realization of the right to health care for all categories of the population.Item Carrying out economic activity in war conditions: legal aspect(Akademické sdružení MAGNANIMITAS, 2022) Ilchenko, Hanna; Sieriebriak, Stanislav; Hryhorenko, Olena; Григоренко, Олена В’ячеславівна; Pavliuchenko, Yuliia; Babiuk, AllaThe current conditions of economic activity in Ukraine pose a threat to the stability of their work in the country's economy, which, in turn, leads to the search for new instruments of legal regulation. Martial law forces enterprises and governing bodies to change the legal policy in favor of the corporate sector. In addition, it is necessary to implement effective measures that can partially restore the economic situation and ensure the stabilization of economic activity as a key strategic factor of national interest. In the context of the threat to the territorial integrity of Ukraine, the issue of optimized legal policy and the mechanism for implementing measures of influence on economic activity is of great importance, which led to the topic of the study. The problem lies in the analysis of modern legal measures and their real impact on economic activity. Modern factors of inhibition of economic activity are high inflation, labor migration, uneven division of the market, and problems of the judiciary. The purpose of the article is to study the legal aspect of economic activity during the war in the example of Ukraine. The task of the study is to implement an analytical study on the development of economic activity and stimulation of the corporate sector to economic activity. The methodology used in the study is the use of theoretical and methodological tools of the legal field of regulation of economic activity and outlining the prospects of their application. The article defines legal measures for the optimization of economic activity, identifies constraining and developing factors, and characterizes further development prospects. With the help of materials of macroeconomic analysis, the priority directions of legal regulation of economic activity in the conditions of war have been determined. The advantage of democracy as a type of political system is its high ability to adapt to new circumstances, constantly change and efficiently compete with other forms of political regime. The factors of the dynamic component of democratic institutions are market economy, developed civil society, the values of pluralism and tolerance. However, the development of democracy is not a linear process. New forms and methods of implementing the principles of democracy are related to the risk of its transformation into autocracy. Any crisis is a challenge for democracy, a test of its stability. In a crisis, traditional principles of democracy lose their effectiveness. Such processes have been observed in the world as a result of the implementation of measures to overcome the coronavirus pandemic. In general, Russian aggression in Ukraine is obviously a greater threat to democracy. The latter not only undermines the foundations of democratic world order and norms of international law, but also testifies to the inability to restrict the aggression of the autocrat applying political, economic and diplomatic levers of influence, indicates the meaninglessness of some tenets about free market, ethnic neutrality and equality of all nations in the international politics. Aim: to outline the main threats of democratization in the world and in Ukraine, to determine the prospects of evolution of democratic political systems, to formulate recommendations for preservation of the democratic values in the current state of affairs. Method: to achieve the aim, it is expedient to apply a comparative method, in particular to compare the historical experience of preserving democratic values in the prolonged military confrontation, to use the experience of dealing with the consequences of previous global crises.Item Civil Society's Involvement in the Post-2014 Political Transition in Ukraine(Ontario International Development Agency, 2025-06-07) Hahin, Andrii; Matvieieiv, Andrii; Piddubnyi, Serhii; Піддубний, Сергій Анатолійович; Filipenko, Larysa; Oliinyk, OlehCivil society plays a key role in the political transformations of Ukraine after 2014, contributing to democratic development, European integration and reform of public administration. In conditions of war, information threats and economic challenges, the relevance of research on civil society and its mechanisms of influence on political processes is significantly increasing. The purpose of the study is to analyze the impact of civil society on public administration and political changes, and the object is the activities of public organizations, volunteer movements and human rights initiatives in Ukraine. The work uses methods of comparative analysis, content analysis of official documents, statistical analysis of sociological data and expert evaluation of scientific publications. The study showed that civil society has become an important factor in the fight against corruption, ensuring transparency of government and the implementation of democratic reforms. At the same time, its effectiveness largely depends on the level of cooperation with state structures and international partners. It was found that digitalization opens up new opportunities for civic activity, but carries the threat of information manipulation. The study also showed that trust in civic initiatives remains consistently high, while trust in state institutions fluctuates depending on political circumstances. The practical significance of the study lies in identifying mechanisms for strengthening civil society through legal, financial, and digital tools. The results can be used to develop state strategies to support civil society, increase public participation, and strengthen democratic institutions in Ukraine. Громадянське суспільство відіграє ключову роль у політичних трансформаціях України після 2014 року, сприяючи демократичному розвитку, європейській інтеграції та реформуванню державного управління. В умовах війни, інформаційних загроз та економічних викликів актуальність досліджень громадянського суспільства та його механізмів впливу на політичні процеси значно зростає. Метою дослідження є аналіз впливу громадянського суспільства на державне управління та політичні зміни, а об'єктом є діяльність громадських організацій, волонтерських рухів та правозахисних ініціатив в Україні. У роботі використано методи порівняльного аналізу, контент-аналізу офіційних документів, статистичного аналізу соціологічних даних та експертної оцінки наукових публікацій. Дослідження показало, що громадянське суспільство стало важливим фактором у боротьбі з корупцією, забезпеченні прозорості влади та впровадженні демократичних реформ. Водночас його ефективність значною мірою залежить від рівня співпраці з державними структурами та міжнародними партнерами. Було виявлено, що цифровізація відкриває нові можливості для громадянської активності, але несе загрозу маніпуляцій інформацією. Дослідження також показало, що довіра до громадянських ініціатив залишається стабільно високою, тоді як довіра до державних інституцій коливається залежно від політичних обставин. Практичне значення дослідження полягає у визначенні механізмів зміцнення громадянського суспільства за допомогою правових, фінансових та цифрових інструментів. The authors analyze the consequences of global world political transformations at the turn of the 20th and 21st centuries for the structuring of the regional security system in Europe after the end of the Cold War and correlate these transformations with modern regional realities in Europe, including war in Ukraine. The studies confirmed that ongoing tendency on world competitiveness justified considering direct and indirect dimensions which influence on the country’s economic security. The authors generalised the factors which affected the economic security of the country. The finding proved that one of the significant indirect parameters is the country image. The authors analysed and summarised the most appropriate definitions of country brand and image. The authors analysed the frequency of country brand and image in the scientific paper. The paper aimed to identify the scientific clusters on the investigation of economic security and the country’s brand. The study used the bibliometric analysis using software VOSviewer, Web of Science and Scopus Tools Analysis. The data of analysis was obtained from the scientific database Scopus and Web of Science for 1991-2019 years. For the analysis, the papers were selected as the criteria as follows: English language; published for 1991-2019 years; contained the keywords brand, image, county and security. The results of the analysis proved that the paper which used the term “country image” is more than “country brand” in Scopus and Web of Science. The findings from the Web of Science and Scopus Tools Analysis confirm the hypothesis on the increasing tendency of publishing activities papers which focused on the analysis of security and country’s image. The visualising of co-authorship by country allowed identifying that the 50% papers published by the scientists with the American, Ukrainian, Canadian, Spanish and Russian affiliations. The VOSviewer results allowed identifying two significant scientific clusters as follows: country image and economic security. Besides, between the two most significant cluster were as mediators: governance, nation branding, developing countries and environment. Besides, analysing the new publication for 2015-2019 years, the most cited papers on economic security connected with analysis not only quantitively economic parameters but also with political, sustainable development and country’s image. The bibliometric analysis formed the background for checking the casual relationship between image and economic security of the country. У статті проаналізовано тенденцію наукових публікацій, що досліджують питання взаємозв’язку між іміджем та рівнем економічної безпеки країни. Авторами проаналізовано та узагальнено наукові підходи щодо визначення детермінантів, які впливають на рівень економічної безпеки країни. При цьому встановлено, що одним із значимих факторів, що потребує врахування при оцінюванні рівня економічної безпеки – імідж країни на світовому ринку. Метою статті є аналіз та виокремлення наукових кластерів, що досліджують питання економічної безпеки та іміджу країни. У дослідженні проведено бібліометричний аналіз з використанням програмного забезпечення VOSviewer, інструментів Web of Science та Scopus Tools Analysis. Вибірку даних для аналізу сформовано з наукометричних баз даних Scopus та Web of Science за 1991-2019 роки. Основними критеріями відбору наукових публікацій були: мова статті – англійська; опубліковані за 1991-2019 роки; містили ключові слова бренд, імідж, стабільність та безпека. Авторами узагальненого частоту використання термінів «бренд країни» та «імідж країни» у наукових публікаціях вчених. Встановлено, що термін «імідж країни» частіше використовується вченими ніж «бренд країни» у наукових публікаціях, що індексуються наукометричними базами даних Scopus та Web of Science. Результати аналізу з використанням інструментів Web of Science та Scopus Tools Analysis підтвердили гіпотезу про зростаючу тенденцію публікацій, що досліджують питання економічної безпеки та іміджу країни. Візуалізація результатів аналізу у розрізі країн дозволила визначити, що 50% робіт, опубліковано вченими з американською, українською, канадською, іспанською та російською афіляціями. Результати бібліометричного аналізу з використанням програмного забезпечення VOSviewer дозволили виокремити два наукових кластери: імідж країни та економічна безпека. Крім того, між двома найбільшими кластерами є такі кластери-посередники як: управління; брендинг націй; країни, що розвиваються; сталий розвиток. Крім того, аналіз публікаційної активності за 2015-2019 роки дозволив визначити тенденцію зростання кількості публікації, що досліджують економічну безпеку країни не лише на основі оцінювання економічних параметрів розвитку країни, а й оцінювання політичної стабільності, сталого розвитку та іміджу країни. The purpose of the scientific research is to highlight the content of the guarantee (principle) of the inviolability of property rights, and how they are embedded in the Fundamental Laws of Ukraine, Poland and Germany. The following general and specifically legal methods of scientific knowledge form the methodological basis of the study: the system-structural method, the method of comparison and logical-legal method. The analysis of constitutional guarantees regarding the inviolability of property rights on the example of Ukraine, Poland and Germany was conducted in the article. According to the results of the conducted research, it is proposed the following separation of the guarantees regarding the inviolability of property rights stipulated by the constitutions guarantees of legislative consolidation of rights and procedures; immediate principles and guarantees of effectuation of the property rights; guarantees of administrative support; guarantees of protection and defense of the property rights. Significance of results and the prospects for further research. The proposed classification makes it possible to more widely define the constitutional guarantees of the property rights, which also makes it possible to provide the legal protection to a wider range of public relations regarding the property. En el curso de los procesos de construcción del estado moderno, la integración europea de Ucrania, así como los eventos negativos que se desarrollan como resultado de la agresión armada de Rusia, el derecho de propiedad como uno de los derechos constitucionales fundamentales está experimentando restricciones y transformaciones. El propósito de la investigación científica es resaltar el contenido de la garantía de la inviolabilidad de los derechos de propiedad, y cómo están incorporados en las Leyes Fundamentales de Ucrania, Polonia y Alemania. Los siguientes métodos generales y específicamente jurídicos del conocimiento científico constituyen la base metodológica del estudio: el método estructural-sistémico, el método de comparación y el método lógico-jurídico. El análisis de las garantías constitucionales con respecto a la inviolabilidad de los derechos de propiedad en el ejemplo de Ucrania, Polonia y Alemania se llevó a cabo en el artículo. De acuerdo con los resultados de la investigación realizada, se propone la siguiente separación de las garantías relativas a la inviolabilidad de los derechos de propiedad previstas en las constituciones: garantías de consolidación legislativa de derechos y procedimientos; principios y garantías inmediatas de efectivización de los derechos de propiedad; garantías de apoyo administrativo; garantías de protección y defensa de los derechos de propiedad. Importancia de los resultados y las perspectivas de futuras investigaciones. La clasificación propuesta permite definir con mayor amplitud las garantías constitucionales de los derechos de propiedad, lo que también posibilita brindar la protección jurídica a una gama más amplia de relaciones públicas en torno a la propiedad.Item Construction of the Moscow-Simferopol highway through the territory of Ukraine as a factor of integration of the Crimea into the economic complex of the UkrSSR (1948–1949)(Indian society for health and advanced research, 2020-03) Satskyi, Pavlo; Сацький, Павло Вікторович; Сацкий, Павел ВикторовичThe problem of the USSR government’s socioeconomic and political motivation with respect to transferring the Crimea from the Russian SFSR to the Ukrainian SSR became especially urgent in 1954. Moreover, that issue was urgent not only for political reasons but also from the viewpoint of development logic and work out and application of socioeconomic development methods. After the end of World War II, the USSR Five-Year Socioeconomic Development Plan (1946 to 1950) was adopted in 1946. Ensuring the agricultural development and solving the food problem in the country were key components of that plan. The next priority matter was the energy base development to be focused on the regions that had prospects for industrial development. In that context, the southern Ukrainian regions were highly promising. The southern Ukrainian areas and the Crimea had a very favorable climate for agricultural development; however, material risks in that region were due to low humidity and frequent droughts. Therefore, the first five-year plan after the war end included construction of the irrigation system in the southern Ukrainian areas and electrification of agriculture. However, economic development of those regions could not be rapid as planned because of low number and density of population. In addition, the problem of logistical development to provide conditions for intensified economic development of the southern Ukrainian areas and the Crimes became obvious. The problem of sparse population and logistical system development needs of the region were interrelated. In the period after the end of World War II, construction processes were mechanized poorly, and mainly low-cost and unskilled labor was used. Meanwhile, collective farms provided reliable concentration and possibilities for rapid mobilization of the workforce. Therefore, the combination of the programs of providing population growth conditions in the Ukraine’s southern regions and the Crimea and buildup of the region’s logistical system in the latter half of 1940s is an issue that is relevant for study. The Moscow-Simferopol motorway construction was carried out within the implementation of the program of logistical system development of the Southern Ukraine and the Crimea in 1948 and 1949. A section of that motorway, Kharkiv-Simferopol, was built owing to workforce and hardware mobilization on the Ukrainian territory. Actually, the workforce was provided by the UkrSSR Ministry of Internal Affairs by involving prison population (detainees and prisoners of war). Again, the basic unskilled work and resources were provided by collective farms who mobilized collective farm workers and vehicles for the motorway construction. Methods of supplying the construction project with maximum use of resources regionally were piloted in the course of that construction. Thereafter, such methods were actively applied for implementing the Kyiv-Odesa highway project and some other large-scale construction projects. Study of the experience of implementing such projects in the years of carrying out the first two USSR Five-Year Socioeconomic Development Plans after the end of World War II provides a better insight into the processes of establishing the regional infrastructure networks. This also offers scope for a deep analysis of the logic of the Crimea’s socioeconomic integration with Ukraine. Проблема соціально-економічної та політичної мотивації керівництва СРСР у питанні передачі Криму від РРФСР до складу УРСР у 1954 р. набула надзвичайної актуальності. Причому актуальність цього питання обумовлено не лише політично, а й з точки зору логіки регіонального розвитку, вироблення й застосування методики соціально-економічного розвитку територій. В рамках реалізації програми розбудови системи логістики півдня України в Криму у 1948–1949 рр. відбувається будівництво траси Москва-Сімферополь. Відрізок цієї траси Харків-Сімферополь будувався завдяки мобілізації робочої сили і технічних засобів на території України. У ході цього будівництва було апробовано методику забезпечення будівництва із максимальним залученням ресурсів на регіональному рівні.
